TO

Require the installation of carbon monoxide detectors in certain premises; to raise public and professional awareness of the dangers of carbon monoxide poisoning; to make new provision with respect to the maintenance of fuel appliances; and for connected purposes.

BE IT ENACTED by the Queen's most Excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the authority of the same, as follows:-
 

Houses in multiple occupation.     1. - (1) A person who-
 
 
    (a) is the owner of,
 
    (b) has control of, or
 
    (c) is the manager of
  a house in multiple occupation is guilty of an offence if that house is not fitted with carbon monoxide detectors in such manner as to make adequate provision for the early detection of dangerous levels of carbon monoxide.
 
      (2) A person guilty of an offence under this section is liable on summary conviction to imprisonment for a term not exceeding two years or to a fine not exceeding level 5 on the standard scale.
 
Maintenance of fuel appliances.     2. - (1) It shall be the duty of a person specified under section 1 of this Act to ensure that any fuel appliance in a house in multiple occupation is inspected by a registered inspector for the purpose of establishing levels of carbon monoxide emitted.
 
      (2) The first inspection under subsection (1) shall take place within six months of this Act coming into effect and further inspections shall take place at intervals of not more than twelve months thereafter.
 
      (3) The Secretary of State shall by regulations determine a class or classes of persons who are "registered inspectors" for the purposes of this section.
 
      (4) A failure on the part of a person to observe a duty under this section shall not of itself render him liable to any criminal or civil proceedings.
 
      (5) If, in any criminal or civil proceedings under this Act, it is alleged that there has been a contravention on the part of of any person of the duty imposed by this section-
 
 
    (a) a failure to comply with the duty may be relied on as tending to establish liability, and
 
    (b) compliance with the duty may be relied on as tending to negative liability.
Requirements.     3. - (1) A local authority officer may require a person specified under section 1(1) of this Act to repair or replace any fuel appliance found to be emitting dangerous levels of carbon dioxide.
 
      (2) A person commits a summary offence if he fails to comply with a requirement under subsection (1) and is liable on conviction to a fine not exceeding level 1 on the standard scale.
 
Information.     4. The Secretary of State shall cause information concerning-
 
 
    (a) the dangers to human health of carbon monoxide poisoning;
 
    (b) measures which may be taken to minimise the risks to human health of carbon monoxide poisoning; and
 
    (c) means of obtaining further advice on carbon monoxide
  to be published and disseminated amongst general practitioners, suppliers of solid, liquid or gaseous fuels, persons who install or maintain fuel appliances, fittings or any other associated apparatus, and other members of the public.
 
Duty on fuel suppliers.     5. It shall be the duty of-
 
 
    (a) every supplier of solid, liquid or gaseous fuel, and
 
    (b) any person who installs or maintains fuel appliances, fittings or associated apparatus
  to promote awareness amongst customers of the dangers of carbon monoxide poisoning.
