Amend the Environmental Protection Act 1990 by extending powers to environmental health officers to intervene in neighbourly disputes involving residential hedgerows; and for connected purposes.

BE IT ENACTED by the Queen's most Excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the authority of the same, as follows:-
 

Statutory nuisance.     1. - (1) Section 79 of the Environmental Protection Act 1990 (statutory nuisances and inspections therefor) is amended as follows.
 
      (2) After paragraph (a) of subsection (1) there is inserted-
 
 
    "(aa) any residential hedgerow planted in such a place, or maintained in such a manner, as to be prejudicial to health or a nuisance;".
      (3) After the definition of "private dwelling" in subsection (7) there is inserted-
 
 
    ""residential hedgerow" means any hedge forming a boundary between two private dwellings;".
Short title.     2. This Act may be cited as the Control of Residential Hedgerows Act 1999.
