To move the following Clause:—

    '. —(1) Section 2 of the National Health Service (Primary Care) Act 1997 is amended as follows—

    (2) In subsection (3), in the definition of "qualifying body" there is substituted for the words after "means"—

      "(a) a company which is limited by shares all of which are legally and beneficially owned by persons falling within paragraphs (a), (b), (c) or (e) of subsection (2); or

      (b) an institution, whether corporate or otherwise, which is established for charitable purposes and is subject to the control of the High Court in the exercise of the court's jurisdication with respect to charities.".'.


Definition of Secretary of State in relation to pharmaceutical price control schemes

    'In sections 30 to 35 of this Act, "Secretary of State" means Secretary of State for Trade and Industry'.


Regulation of midwifery

To move the following Clause:—

    '.—(1) The Secretary of State may by Order provide for—

      (a) the Midwifery Board of the Central Council to have the functions of—

          (i) determining the conditions of admission to training as a midwife;

          (ii) determining the type, content, and standard of training to be undertaken before and after registration as a midwife;

          (iii) giving advice for midwives about standards of professional conduct; and

          (iv) setting standards for midwifery practice, including the provision of supervision of midwives.

    (2) In subsection (1) "Central Council" means the United Kingdom Central Council for Nursing, Midwifery and Health Visiting.'.


Registration of health service personel having contact with anaesthetised patients

To move the following Clause:—

    '.—(1) The Secretary of State shall, within 12 months of any part of this Act coming into force, by regulations make provision—

      (a) for the registration of all non-medically qualified personnel providing care to anaesthetised patients or having access to such patients during surgery; and

      (b) securing that only medically qualified personnel and persons registered in accordance with paragraph (a) above are employed in positions caring for, or having access to, anaesthetised patients during surgery.

    (2) The regulations made under subsection (1) above may make such provision as the Secretary of State considers appropriate with regard to—

      (a) keeping the register of members admitted to practice,

      (b) determining standards of education and training for admission to practice,

      (c) giving advice about standards of conduct and performance,

      (d) administering procedures (including making rules) relating to misconduct, unfitness to practise and similar matters,

    ( ) in relation to those persons included within subsection (1)(a) above in respect of whom arrangements have not been made under the provisions of section 54 of this Act.'.
