Make provision about cancer services in the United Kingdom; to make provision for monitoring and improving the quality of cancer treatment and care provided by the National Health Service; to require the Secretary of State to undertake a new review and report on cancer services in the United Kingdom; and to provide for making such information available to the general public.

BE IT ENACTED by the Queen's most Excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the authority of the same, as follows:-
 

Duty of prescribed authorities to monitor and improve cancer care services.     1. - (1) A prescribed authority shall be under a duty to monitor and improve the quality of health care which it provides in respect of cancer.
 
      (2) In this section "prescribed" means prescribed in regulations made by the Secretary of State.
 
Review of cancer care services.     2. - (1) Subject to section 3(1) below, the Secretary of State shall from time to time conduct a review of cancer care services provided by the National Health Service and shall cause the results of each such review to be published.
 
      (2) In conducting a review under subsection (1) the Secretary of State shall have regard to-
 
 
    (a) the management,
 
    (b) the nature and quality of provision, and
 
    (c) the accessibility and availability,
  of cancer care services and to such other matters as he considers to be relevant.
 
      (3) The Secretary of State shall take such measures as he considers to be necessary to ensure that the results of a review under subsection (1) are made available to members of the public.
 
Review of cancer care services: supplementary.     3. - (1) The Secretary of State may provide in regulations for a review under section 2(1) to be undertaken by a specified body and for the specified body to publish the results of that review.
 
      (2) Regulations under subsection (1) shall include provision regarding-
 
 
    (a) the time at which and the manner in which a review shall be conducted;
 
    (b) the matters to be considered or taken into account in connection with a review;
 
    (c) the persons to whom any advice, information or report shall be given or made; and
 
    (d) the publication of reports and other means of making information publicly available.
      (3) Before making regulations under subsection (1), the Secretary of State shall consult-
 
 
    (a) authorities prescribed under section 1; and
 
    (b) such providers of cancer care services as he considers it appropriate to consult.
Expenses.     4. There shall be paid out of money provided by Parliament any expenses of the Secretary of State under or by virtue of this Act.
 
Application to Scotland and to Wales.     5. - (1) For the purposes of the Scotland Act 1998, any provision of this Act which extends to Scotland is taken to be a pre-commencement enactment within the meaning of that Act.
 
      (2) Any function of a Minister of the Crown under any of the provisions of this Act, so far as exercisable in relation to Wales, is exercisable instead by the National Assembly for Wales.
 
      (3) Section 44 of the Government of Wales Act 1998 (parliamentary procedures for subordinate legislation) is to have effect in relation to any function to make subordinate legislation which is exercisable by the Assembly by virtue of subsection (2) as if it had been conferred on the Assembly by an Order in Council under section 22 of that Act (transfer of Ministerial functions).
 
Short title and extent.     6. - (1) This Act may be cited as the Cancer Care Act 1999.
 
      (2) This Act extends to Scotland.
 
      (3) This Act except section 5 extends to Northern Ireland.
