NOTE ON BRITISH/SPANISH AGREEMENT TO FISH IN WATERS
SURROUNDING GIBRALTAR,
3 NOVEMBER 1998
I. OBSERVATIONS
1. The commitment, understanding and agreement,
ratified by the Ministers of Foreign Affairs of both Spain and
the United Kingdom in Luxembourg on 5 October, is the result of
a long negotiating process between the British Embassy on the
one side, and the General Fishing Secretariat and the Fishing
Sector affected, on the other side.
2. The objective is to resume the traditional
fishing practice of 1997. This objective has emerged from the
essential elements of the commitment, understanding and agreement.
3. This is a commitment, understanding and verbal
agreement. This is due to the fact that both Spain and the United
Kingdom do not have in mind to better our position regarding sovereignty
over the waters in this dispute, which is what would have been
the case if the agreement would have been a written agreement,
as one of the positions would have prevailed over the other.
4. We have recommended to the Fishing Sector
that they should accept not to do any fishing in the denominated
"Admiralty Waters", both for practical reasons as to
leave free access to the Gibraltar Port Authorities and the security
for the British Military Naval Base, as well as for the fact that
fishing would be prohibited, as stated in the Community and Spanish
Legislations.
Thus, the requests of the Spanish Legislation
as well as the needs of the military authorities of the United
Kingdom and the security of the maritime traffic have been respected.
Now, on the Spanish part, this does not imply the recognition
of the British Jurisdiction over this zone, neither does it imply
the acceptance of these fishing boats in our water by the British
authorities.
II. TERMS OF
THE AGREEMENT
The British/Spanish commitment, understanding
or agreement reached, permits fishing in these waters (one and
a half miles in the east—levante—and three miles in
the west—poniente) surrounding the Rock, as per the following
lines:
1. The Naval Gibraltar Police will exercise
its utmost restraint and prudence towards the fishermen, but will
also expect reciprocity in the fishermen's attitude, if they are
forced to act upon instructions of their superiors.
2. Fishing will not be permitted in the waters
known as "Admiralty Waters" or in "Military Zones".
(This is a strip of two hundred metres wide, towards the bay and
parallel to the jetty at the entrance of the Gibraltar Port.)
The United Kingdom has kindly facilitated the pertinent Maritime
Map. The totality of the security zone is near the rocky side,
measures 35 metres and must compulsorily be respected by Spanish
boats, in accordance with the Royal Decree 2349/84. In any case,
all boats working in the area must respect the strip of two hundred
metres wide, which is the military zone. By fishing in the "Military
Zone", one understands that our nets should be lowered and
that there will be no fishing boats or heavily lit boats, only
the ones in transit.
The number of boats with their nets lowered
cannot exceed three, in any given moment.
3. The total presence of Spanish fishing boats
in any given moment, cannot be very numerous.
Compromiso Hispano-Britanico para la Pesca
en las Aguas Proximas al Penon
I. OBSERVACIONES
1. El compromiso, entendimiento o acuerdo, ratificado
por los Ministros de Asuntos Exteriores de Espana y el Reino Unido
en Luxemburgo el dia 5 de octubre, es el resultado de un largo
proceso negociador entre la Embajada del Reino Unido por una parte,
y la Secretaria General de Pesca, el Ministerio de Asuntos Exteriores
y el sector pesquero afectado por otra.
2. El objetivo perseguido es recuperar la practica
tradicional de pesca anterior a 1997. Este objetivo ha quedado
plasmado en los elementos constitutivos del compromiso entendimiento
o acuerdo.
3. Se trata de un compromiso, entendimiento
o acuerdo oral. Ello obedece a que tanto Espana como el Reino
Unido no hemos pretendido una mejora de nuestras posiciones sobre
la soberania de las aguas en litigio lo que necesariamente hubiera
sido el caso en un acuerdo formal por escrito pues una de las
dos posiciones habria necesariamente prevalecido sobre la otra.
4. Hemos recomendado a nuestro sector pesquero
que aceptara no faenar en las denominadas "aguas del Almirantazgo"
o "zona de seguridad militar", tanto por razones objetivas
como dejar libres los accesos al puerto de Gibraltar y las derivadas
de la seguridad militar de la base naval britanica, como por el
hecho de que la pesca estaria prohibida conforme a las legislaciones
comunitaria y espanola.
Con ello, se han las exigencias de la legislacion
espanola con las necesidades militares del Reino Unido y de la
seguridad de la navegacion maritima. Ahora bien, por parte de
Espana, ello no implica reconocimiento de jurisdiccion britanica
alguna sobre esa zona, como tampoco la aceptacion britanica de
nuestros pesqueros en las aguas en litigio implica lo contrario.
II. TÉRMINOS
DEL COMPROMISO
El compromiso, entendimiento o acuerdo hispano-britanico
alcanzado permite la pesca en las aguas en litigio (milla y media
en poniente y tres millas en levante) proximas al Penon, de acuerdo
con las siguientes lineas:
1. La policia naval gibraltarena ejercera la
maxima contencion y prudencia, pero espera en reciprocidad actitudes
de respeto de nuestros pescadores si tuviera que impartir instrucciones.
2. La pesca no estara permitida en las denominadas
"aguas del Almirantazgo" o "zona de seguridad militar".
(Se trata de una franja de 200 metros de anchura hacia el interior
de la bahia y paralela a los diques de entradas al puerto de Gibraltar.
El Reino Unido ha facilitado la correspondiente carta marina.
La totalidad de la zona de seguridad de 200 metros se encuentra
dentro de la isohota de los 35 metros que deben obligatoriamente
respetar los barcos espanoles de acuerdo con el Real Decreto 2349/84.
De cualquier manera, todos los barcos espanoles que faenan en
la zona deben respetar la franja de 200 metros de anchura de la
"zona de seguridad militar". Por pesca en la "zona
de seguridad militar" se entiende tanto tener las redes caladas
como la presencia de barcos pesqueros o barcos luceros, salvo
en transito.
El numero de barcos con sus redes caladas en
un momento determinado no debe exceder de tres.
3. La presencia total de pesqueros espanoles
en un momento determinado no debe de ser muy numerosa.
