Local authority powers in relation to tourist services

Licensing of tour bus vehicles
Mr Don Foster NC24 To move the following Clause:'.(1) A local transport authority within the meaning of section 92(4) of this Act may on the receipt of an application from the proprietor of a vehicle for the grant of a licence to use that vehicle as a tour bus vehicle, grant in respect thereof a vehicle licence. (2) A local transport authority shall not grant such a licence unless they are satisfied that the vehicle is suitable in type, size, design and mechanical condition for use as a tour bus vehicle. (3) Except as authorised by this section
(4) A local transport authority may attach to the grant of a licence of a tour bus vehicle under this section such conditions as the authority may consider reasonably necessary. (5) Any person aggrieved by either the granting by a local traffic authority of a tour bus licence or by the authority's refusal to do so, or by any conditions specified in such a licence, may appeal to a magistrates' court. (6) A local transport authority may suspend or revoke or refuse to renew the licence granted to the proprietor of a tour bus vehicle on any of the following grounds
(7) Any proprietor aggrieved by a decision of a local transport authority under this subsection may appeal to a magistrates' court. (8) For the purposes of subsections (1) and (2) above, a 'tour bus' is a vehicle used to provide one or more special services for tourists along routes with historic or visual interest for the purposes of sightseeing.'.
