Clause     182,     page     101,     line     3,     at end add—

    '(6) Before exercising any powers under this Chapter and prior to each subsequent year that this Chapter remains in force, the Secretary of State shall lay a report for the forthcoming year before both Houses of Parliament for approval by each House, setting out the manner in which he shall exercise his functions under this Chapter, including—

      (a) a full explanation of the manner in which the Authority intends to exercise its functions in accordance with subsections (2) and (3);

      (b) the calculations the Authority has used to arrive at its conclusions;

      (c) the decisions the Authority will make during the year in question to achieve its objectives.'.

    '(6) In section 28(5) of the Railways Act 1993 for the definition of "discount fares scheme" substitute " 'discount fares scheme' means any scheme for enabling any class of persons, including those who are young, elderly or disabled, to travel by railway at discounted fares, subject to compliance with such conditions (if any) as may be imposed by or under the scheme."

    (7) In exercising its function and powers under this section and under section 28 of the 1993 Railways Act, the Authority shall ensure that franchisees give full publicity and make available information to railway passengers about discount fares schemes, and shall bring forward further schemes where it appears to the Authority that such schemes are likely to contribute to its purposes under section 180 and its duties and functions under this section.'.

    '(2) In formulating such directions and guidance under subsection (1) the Scottish Ministers shall have regard to any directions or guidance given to the Authority by the Secretary of State under section 181(3) or 182(5).

    (3) In the event that the Authority is of the opinion that

      (a) any direction or any guidance under subsection (1) is inconsistent with any direction or guidance given under section 181(3) or 182(5), or

      (b) would require the expenditure by the Authority of any money not provided to it out of the Scottish Consolidated fund, or

      (c) would adversely affect any railway passenger services in England other than those mentioned in subsection 1(b),

    the Authority shall notify the Scottish Ministers of its opinion and the reasons for it, and refer the matter to the Secretary of State for a direction under section 182(5).

    (4) The Secretary of State, in formulating his section 182(5) direction in relation to any matter referred to him under subsection (3), shall consult with and have regard to the views of, the Scottish Ministers.'.
