(6) Where a holder of a licence to operate railway assets under section 8 of the Railways Act 1993 wishes to dispose of land in its ownership which has been used for railway purposes in the period since 1st January 1994, the licence holder shall first offer the land to the Authority which shall use the procedures and consultation under subsection (4) to identify any potential transport interest in that land. (7) Where under subsection (6) the Authority identifies a potential transport interest in land to be disposed of by a licence holder the Authority shall have the right of first refusal to purchase that land at a valuation to be agreed but reflecting the use of the land for transport purposes.'.
