    '(1) The Secretary of State shall within one year of the passing of this Act make regulations requiring local authorities to ensure that an increasingly greater proportion of newspapers and magazines produced shall be collected and recycled.'.

    '(3) Newspaper publishers shall be required, in close co-operation with the Government, to continue to achieve stringent targets compatible with factors beyond the control of the industry.'.

    '. Any person who fails to comply with section 1(2), 1(3) or 2 shall be guilty of an offence and shall be liable—

      (a) on summary conviction, to a fine not exceeding the statutory maximum; or

      (b) on conviction on indictment, to a fine.'.
