Legal aid

To move the following Clause:—

    '.—(1) After section 75K of the Army Act 1955 there is inserted—

      "75L Legal aid for advice, assistance and representation, shall be available for anyone in military custody or being interviewed by Services Police outside England and Wales as it is for anyone in England and Wales and section 47(6) of the Legal Aid Act 1988 shall be construed accordingly".

    (2) After section 75K of the Air Force Act 1955 there is inserted—

      "75L Legal aid for advice, assistance and representation, shall be available for anyone in air force custody or being interviewed by Services Police outside England and Wales as it is for anyone in England and Wales and section 47(6) of the Legal Aid Act 1988 shall be construed accordingly".

    (3) After section 47L of the 1957 Act there is inserted—

      "47M Legal aid for advice, assistance and representation, shall be available for anyone in Naval custody or being interviewed by Services Police outside England and Wales as it is for anyone in England and Wales and section 47(6) of the Legal Aid Act 1988 shall be construed accordingly".'.


Custodial officers

To move the following Clause:—

    '.—(1) After section 75M of the Army Act 1955 there is inserted—

"Custodial officers.75N.—(1) Custodial officers shall be appointed for the purposes of the Act by the General Officer Commanding.

    (2) Custodial officers shall be commissioned officers who have been trained in dealing with accused persons kept in military custody or subject to court-martial proceedings."

    (2) After section 75M of the Air Force Act 1955 there is inserted—

"Custodial officers.75N.—(1) Custodial officers shall be appointed for the purposes of this Act by the Air Officer Commanding.

    (2) Custodial officers shall be commissioned officers who have been trained in dealing with accused persons kept in air-force custody or subject to court-martial proceedings."

    (3) After section 75N of the 1957 Act there is inserted—

"Custodial officers.75O.—(1) Custodial officers shall be appointed for the purposes of this Act by the Admiral Commanding.

    (2) Custodial officers shall be commissioned officers who have been trained in dealing with accused persons kept in naval custody or subject to court-martial proceedings.".'.
