To move the following Clause:—

    '.—(1) No later than the commencement of the meeting of any overview or scrutiny committee, the leader of each political group with a least one member on the committee shall inform the Head of the Paid Service in writing whether or not any matter on the agenda has been the subject of prior discussion at any meeting of the relevant group or of part of it and of whether or not the judgement of any relevant member is likely to be constrained by the rules of the relevant group or political party.

    (2) In this subsection, "political group" and "leader" have the same meaning as in sections 15 and 16 of the Local Government and Housing Act 1989 and in regulations made under Schedule 1 to that Act.'.

Clause     48,     page     31,     line     2,     at end insert—

    '(9) A member or co-opted member required to vacate his office under subsection 2(b), 4(b) or 6(b) may appeal to the Standards Board for England for a decision that he may remain in office on the grounds that any of the following are in his case unreasonable or oppressive:

      (a) the relevant code of conduct;

      (b) the size, composition, or terms of reference of the standards committee of the authority of which he is a member;

      (c) the provisions, if any, made under section 49(6), 49(7), 50(4) or 50(6).

    (10) A member or co-opted member appealing under subsection (9) shall remain in office until his appeal has been determined by the relevant Standards Board, who shall give written reasons for their decision.

    (11) If his appeal is rejected the member or co-opted member shall vacate his office on the day following the issue of such decision; if his appeal is upheld his office shall not become vacant under this section.'.

    'Where matters considered by an interim tribunal or a case tribunal are or become the subject of criminal proceedings in a court, it shall be open to that court, in considering any penalty resulting from verdict of guilty, to apply a requirement, as part of any penalty, that a restitution order be made so that any loss to the local taxpayer is repaid.'.

REMAINING NEW CLAUSE

Duty to have regard to equality of opportunity

To move the following Clause:—

    '.—(1) Each local authority shall make appropriate arrangements with a view to securing that—

      (a) in the exercise of its powers, and

      (b) in the discharge of its functions,

    there is due regard to the principle that there should be equality of opportunity for all people.

    (2) Each local authority shall have regard to the need

      (a) to promote equality of opportunity for all persons irrespective of their race, sex, disability, age, sexual orientation or religion;

      (b) to eliminate unlawful discrimination; and

      (c) to promote good relations between persons of different racial groups, religious beliefs and sexual orientation.

    (3) Subsection (2) is without prejudice to subsection (1) and is subject to any provision made under any other enactment.

    (4) Each local authority shall publish a report in each year containing—

      (a) a statement of the arrangements made in pursuance of subsection (1) which had effect during the year which is the subject of the report, and

      (b) an assessment of how effective those arrangements were in promoting equality of opportunity.'.
