    '( ) In the discharge of his duties under this Part each member of an overview and scrutiny committee of a local authority shall act independently of any political party interest.

    ( ) No later than the commencment of a meeting of an overview and scrutiny committee of a local authority any member of the committee who shall have attended or has knowledge of any prior meeting of members of the authority (not being a meeting of the executive or of an overview and scrutiny committee) at which any matter on the agenda shall have been discussed shall declare such attendance or knowledge to the meeting.'.

    '( ) It is the duty of the head of paid service of any local authority operating executive arrangments to ensure that each overview and scrutiny committee of that authority has at its disposal adequate personnel and resources to enable it to discharge its functions under this Part effectively and independently of the executive.

    ( ) The head of paid service shall have regard to subsection (     ) in discharging his duties under section 4(2) of the Local Government and Housing Act 1989.

    ( ) In this section "head of paid service" means the person designated under section 4(1) of the local Government and Housing Act 1989.'.
