Penalties where licence is forfeit

    '169I. A person guilty of an offence under section 169A, 169B, 169C, 169E, 169F or 169G of this Act whose justices' licence has been forfeit shall not be granted a new licence in respect of any premises unless—

      (a) in respect of an on-licence, it is subject to such conditions as the licensing justices believe to be in the public interest in preventing a further offence; or

      (b) in respect of an off-licence, he can show that he has attended a British Institute of Innkeeping course since the removal of his previous licence

    and he undertakes to adopt a proof of age scheme if a new licence is granted.'.

    '169I.—(1) Where an offence under section 169A, 169B, 169C, 169E, 169F or 169G of this Act causes personal injury or loss to a young person, the court shall consider an order for compensation in preference to a fine.
