Defence against prosecution

    '169I. Without prejudice to any defence otherwise available under any provision of this Act, it shall be a defence for a person charged with an offence under section 169A, 169B, 169C, 169E, 169F or 169G of this Act to prove—

      (a) that he had no reason to suspect that the person was under eighteen, or

      (b) that he exercised all due diligence to avoid the commission of an offence.'.

Alcopops

    '169I.—(1) For the purposes of sections 169A, 169B, 169C, 169E, 169F and 169G of this Act intoxicating liquor includes alcopops.

    (2) "Alcopops" means a drink which contains alcohol in any quantity and which by its packaging, colour, labelling, marketing or advertising is not readily identifiable as an alcoholic beverage.'.

Suspension of licence

    '169I. Where on a complaint being made to the licensing justices by a constable of an alleged contravention of section 169A, 169B, 169C, 169E, 169F or 169G of this Act the licensing justices are satisfied that it is in the public interest that the justices' licence should be suspended they may suspend the licence in respect of the licensed premises in relation to which the alleged offence was committed pending the conclusion of proceedings against the licence holder.'.
