    '(2) Where subsection (3) applies, the Secretary of State may in relation to appointments on any occasion under section 37 by order permit the appointment of an odd or even number of persons of whom:

      (a) fewer than one half are persons who are treated as Roman Catholic, or

      (b) fewer than one half are persons who are not so treated

    but only insofar as is necessary to appoint the number of police service trainees which the Chief Constable requires.

    (3) This subsection applies where the Secretary of State is satisfied that were appointments on any occasion made in compliance with subsection (1), the number of police service trainees which the Chief Constable requires could not be appointed.

    (3A) Before making an order under subsection (2), the Secretary of State shall consult:

      (a) the Board;

      (b) the Chief Constable; and

      (c) the Equality Commission.

    (3B) Where on any occasion the Secretary of State makes an order under subsection (2), on every subsequent occasion that it is possible to do so while appointing the number of police service trainees required by the Chief Constable on those occasions, the Secretary of State shall by order permit the appointment of an odd or even number of persons of whom:

      (a) fewer than one half are persons who are treated as Roman Catholic, or

      (b) fewer than one half are persons who are not so treated

    as appropriate, until such time as among the aggregate of all appointments made by orders under subsection (2) and under this subsection:

      (a) half are persons who are treated as Roman Catholic, and

      (b) half are persons who are not so treated.'.
