Amend the Human Fertilisation and Embryology Act 1990 with regard to the status of the father of a child conceived posthumously.

BE IT ENACTED by the Queen's most Excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the authority of the same, as follows:-
 

Amendment of the 1990 Act.     1. Section 28 of the Human Fertilisation and Embryology Act 1990 (meaning of "father") is amended, by inserting after subsection (6) the following new subsection-
 
 
    "(6A) Paragraph (b) of subsection (6) does not apply where at the time of the man's death the woman and the man-
 
 
    (a) were married to each other,
 
    (b) were otherwise living as man and wife, or
 
    (c) had been receiving treatment services together from a person to whom a licence applies."
Citation and extent.     2. - (1) This Act may be cited as the Human Fertilisation and Embryology (Amendment) Act 2000.
 
      (2) This Act extends to Northern Ireland.
