1Message from the Lords,—A Message was brought from the Lords, as follows:

Crown Prosecution Service Inspectorate Bill [Lords],—The Lords have passed a Bill to make provision for inspection of the Crown Prosecution Service; to which the Lords desire the concurrence of this House.

The Lords have agreed to the Representation of the People Bill, with Amendments; to which the Lords desire the concurrence of this House.

2Crown Prosecution Service Inspectorate Bill [Lords],—The Crown Prosecution Service Inspectorate Bill [Lords] was read the first time; and ordered to be read a second time to-morrow and to be printed [Bill 80].

3Representation of the People Bill,—Lords Amendments to the Representation of the People Bill to be considered to-morrow and to be printed [Bill 81].

4Regulation of Investigatory Powers Bill,—The Regulation of Investigatory Powers Bill was, according to Order, read a second time and stood committed to a Standing Committee.

5Regulation of Investigatory Powers Bill [Money],—Her Majesty's Recommendation having been signified to the proposed Motion relating to Regulation of Investigatory Powers Bill [Money];

A Motion was made, and the Question being put forthwith, pursuant to Standing Order No. 52 (Money resolutions and ways and means resolutions in connection with bills), That, for the purposes of any Act resulting from the Regulation of Investigatory Powers Bill, it is expedient to authorise the payment out of money provided by Parliament of—

(a) any expenditure incurred by the Secretary of State for or in connection with the carrying out of his functions under the Act;

(b) any expenditure attributable to arrangements made by the Secretary of State under the Act for the making of contributions towards the costs incurred by persons in complying with requirements under the Act to obtain or disclose any communications data;

(c) any expenditure attributable to arrangements made by the Secretary of State under the Act for the making of contributions towards the costs incurred by persons in complying with notices given under the Act for the disclosure of keys to protected information;

(d) any allowances payable under the Act to the Interception of Communications Commissioner or the Covert Investigations Commissioner; and

(e) any increase attributable to the Act in the sums which are payable out of money so provided under any other Act—(Mr Mike Hall):—It was agreed to.

6Humanitarian Aid and External Co-operation,—A Motion was made, and the Question being put forthwith, pursuant to Standing Order No. 119 (European Standing Committees), That this House takes note of European Union Document Nos. 10705/99, the Commission's Annual Report on humanitarian aid 1998, 10497/99, the Commission's Annual Report on TACIS 1998, 11203/99, Commission staff working paper: Report for 1998 on the evaluation of external co-operation, and un-numbered Explanatory Memorandum from the Department for International Development dated 5th November 1999 on a Commission Communication on the assessment and future of Community humanitarian activities; and supports the Government's policy of working in partnership with the European Community to improve the management, organisation and effectiveness of development assistance administered by the European Community institutions—(Mr David Jamieson):—It was agreed to.

7Carers and Disabled Children Bill [Money],—Her Majesty's Recommendation having been signified to the proposed Motion relating to Carers and Disabled Children Bill [Money];

Resolved, That, for the purposes of any Act resulting from the Carers and Disabled Children Bill, it is expedient to authorise the payment out of money provided by

And a Motion being made, and the Question being proposed, That the Bill be now read a second time;

An Amendment was proposed to the Question, to leave out from the word ‘That' to the end of the Question and add the words ‘this House declines to give a Second Reading to the Criminal Justice (Mode of Trial) (No. 2) Bill which, while making provision for determining the mode of trial in the case of offences triable either summarily or on indictment, fails properly to safeguard or maintain the right to trial by jury in either way offences which may result in serious punishment and loss of livelihood', instead thereof.—(Mr Robert Marshall-Andrews.)

7Opposition Day [7th allotted day],—It being an allotted day at the disposal of the Leader of the Opposition in pursuance of Standing Order No. 14 (Arrangement of public business), the House proceeded to consider Opposition business.

Financial Provision And Clinical Priorities in The National Health Service,—A Motion was made, and the Question being proposed, That this House deplores Her Majesty's Government's clinical and financial mismanagement of the NHS; condemns the distortion of clinical priorities resulting from the Prime Minister's refusal to abandon the Government's flawed waiting list initiative, which is described by the medical profession as anathema to them and which has resulted in some of the sickest patients waiting longer than necessary for treatment; notes the financial chaos in Trusts and Health Authorities as a result of ministerial incompetence; and deprecates the misleading of the public about funding as a result of the Treasury's culture of repeatedly re-announcing financial decisions, and the practice of using the NHS as a means of providing publicity and photo opportunities for Ministers, putting political priorities before the morale of dedicated and hard-working NHS staff and to the detriment of patient care—(Dr Liam Fox);

An Amendment was proposed to the Question, in line 2, to leave out from the word ‘House' to the end of the Question and add the words ‘welcomes the Government's modernisation programme for the NHS and the reduction in waiting lists and times that are being achieved through the dedication and hard work of NHS staff; notes the progress being made on recruiting more doctors and more nurses, building more hospitals, treating more patients and modernising more services; applauds the Government's decision to make tackling cancer, coronary heart disease and mental illness a priority; believes that financial provision for the NHS would be reduced as a consequence of the Conservatives' Tax Guarantee and that clinical need would be abandoned in favour of ability to pay under the Conservatives' health plans', instead thereof.—(Mr Secretary Milburn.)

Resolved, That this House welcomes the Government's modernisation programme for the NHS and the reduction in waiting lists and times that are being achieved through the dedication and hard work of NHS staff; notes the progress being made on recruiting more doctors and more nurses, building more hospitals, treating more patients and modernising more services; applauds the Government's decision to make tackling cancer, coronary heart disease and mental illness a priority; believes that financial provision for the NHS would be reduced as a consequence of the Conservatives' Tax Guarantee and that clinical need would be abandoned in favour of ability to pay under the Conservatives' health plans.

Regulatory Burdens on Small Business,—A Motion was made, and the Question being proposed, That this House opposes the growing regulatory burdens that the Government has added to business costs; deplores the failure of the Government to understand the contribution that the small business sector makes to employment, growth and UK trade; calls on the Government to recognise the failure of the Better Regulation Task Force and the consequences of ill-thought-through legislation and regulations that have damaged

small business; and condemns the Department of Trade and Industry for unco-ordinated policy initiatives and for diminishing the status of small business debate in the House of Commons—(Mrs Angela Browning);

An Amendment was proposed to the Question, in line 2, to leave out from the word ‘House' to the end of the Question and add the words ‘welcomes the action taken by Her Majesty's Government to foster an environment in which small business can flourish, with macro-economic stability, a 10 per cent. starting rate of corporation tax, a research and development tax credit, regulation introduced in ways that minimise burdens on business, and the creation of the Small Business Service through which for the first time there will be at the heart of Government an institution dedicated to representing the interest of, and improving the services to, small firms; congratulates the ongoing work being undertaken by the Better Regulation Task Force, chaired by Lord Haskins, in spearheading the Government's campaigning for better regulation; and contrasts this with the boom and bust policies of the previous administration, which lead to 15 per cent. interest rates, double digit inflation and the collapse of thousands of small firms', instead thereof.—(Mr Secretary Byers.)

Resolved, That this House welcomes the action taken by Her Majesty's Government to foster an environment in which small business can flourish, with macro-economic stability, a 10 per cent. starting rate of corporation tax, a research and development tax credit, regulation introduced in ways that minimise burdens on business, and the creation of the Small Business Service through which for the first time there will be at the heart of Government an institution dedicated to representing the interest of, and improving the services to, small firms; congratulates the ongoing work being undertaken by the Better Regulation Task Force, chaired by Lord Haskins, in spearheading the Government's campaigning for better regulation; and contrasts this with the boom and bust policies of the previous administration, which lead to 15 per cent. interest rates, double digit inflation and the collapse of thousands of small firms.

5.—(1) A Committee appointed to draw up Reasons shall report before the conclusion of the sitting at which it is appointed.

Miscellaneous

6. If the House is adjourned, or the sitting is suspended, before the expiry of the period at the end of which proceedings are to be brought to a conclusion under this Order, no notice shall be required of a Motion made at the next sitting by a Minister of the Crown for varying or supplementing the provisions of this Order.

7.—(1) In this paragraph “the proceedings” means proceedings on the Consideration of Lords Amendments, on any further Message from the Lords on the Bill, on the appointment and quorum of a Committee to draw up Reasons and the Report of such a Committee.

(2) Standing Order No. 15(1) (Exempted business) shall apply to the proceedings.

(3) The proceedings shall not be interrupted under any Standing Order relating to the sittings of the House.

(4) No dilatory Motion with respect to, or in the course of, the proceedings shall be made except by a Minister of the Crown; and the Question on any such Motion shall be put forthwith.

8. If proceedings on a Motion for the Adjournment of the House would, by virtue of Standing Order No. 24 (Adjournment on specific and urgent matter that should have urgent consideration), commence at a time when proceedings to which paragraph 7 applies are in progress, proceedings on the Motion shall be postponed to the conclusion of those proceedings—(Mr Mike Hall);
