ANNEX II: An Independent Board to Deal with Complaints to the Planning Inspectorate

Although all complaints would be handled by the independent board, the right of appeal to the High Court would remain. For complaints about appeal decisions, appellants would have to choose between the court and the board. In cases where a complaint had been referred to, and decided by, the board, it would be possible to appeal to the High Court against the board's decision on a point of law within six weeks of the board's decision, or the date of an Inspector's reviewed decision stemming from the board's directed review. In these cases the right of appeal would be limited to the amended/reviewed decision.
