TEMPORARY WAIVER AND PERMISSION
1. In pursuance of paragraph 3 of article 8 of
Council Regulation 2407/92 on licensing of air carriers and article
102 of the Air Navigation (No 2) Order 1995 the Secretary of State
hereby:
(a) waives the requirement as to aircraft
registration the subject of the option selected by him by virtue
of paragraph 2(a) of the said article 8, and
(b) grants permission to Canada 3000 to take
on board or discharge any passengers or cargo in the United Kingdom
where valuable consideration is given or promised in respect of
such carriage.
2. The waiver granted by paragraph 1(a)
above is valid only to enable Air 2000 to use the aircraft specified
in paragraph 3(b) below to meet the temporary needs of Air 2000
identified in Air 2000's application to the Department of Transport
dated 31 December 1996.
3. The permission granted by paragraph 1(b)
above is subject to the following conditions:-
(a) Canada 3000 may only operate flights
pursuant to this permission on behalf of Air 2000 to meet the
temporary needs of Air 2000 referred to in paragraph 2 above;
(b) only Canadian registered Boeing 757 aircraft
registration C-FOOG may be used;
(c) Canada 3000 shall not operate on any
flights pursuant to this permission other than flights, which
Air 2000 could lawfully operate;
(d) Canada 3000 shall comply with the terms
of the operating licence granted to Air 2000 by the Civil Aviation
Authority and also the terms of any route licence so granted or
instrument made under section 64(2) of the Civil Aviation Act
1982 relating to flights on the route in question by Air 2000;
(e) the name Air 2000 shall be displayed
on the aircraft and all services performed under this permission
shall have assigned to them Air 2000 flight numbers;
(f) the aircraft shall be operated by Canada
3000 crew.
4. This waiver and permission shall come
into force on 5 July 1997 and, unless previously revoked or suspended,
it shall expire immediately before 15 November 1997.
