Registration of car park operators

To move the following Clause:—

    '.—(1) Any person who carries on business as a car park operator in the area of a local authority without being registered for that area by the authority shall be guilty of an offence and liable on summary conviction to a fine not exceeding level 5 on the standard scale.

    (2) For the purposes of this section a person carries on business as a car park operator if he carries on a business which consists wholly or partly in the provision of parking spaces for motor vehicles in areas and premises reserved for that purpose and for which he makes a charge.

    (3) In this section "registered" means registered in a register established and maintained by a local authority under subsection (4); and cognate expressions shall be construed accordingly.

    (4) Every local authority shall establish and maintain a register for their area of persons carrying on business as car park operators in that area.

    (5) The register shall, subject to any requirements that may be prescribed, be in such form as the local authority consider appropriate.'.


Relief of small motor salvage operators from excessive expense and bookkeeping, etc

To move the following Clause:—

    '.—(1) Where a person who carries on the business of a motor salvage operator has a turnover from the activities that are specified in section 1(2) of less than £1,000,000 per annum, the maximum fee that a local authority may determine under section 3(1)(b) shall be calculated on a sliding scale from—

    (a) turnover less than £100,000 per annum: maximum fee that may be determined £20, to

    (b) turnover less than £1,000,000 per annum: maximum fee that may be determined £200.

    (2) Where a person who carries on the business of a motor salvage operator purchases:

    (a) a part of a motor vehicle for less than £20, or

    (b) five or more parts together for less than £100,

    he shall not be obliged by such regulations as may be made under section 7(1) to keep a record of the description of the part or parts (save that the part in question has been marked with a vehicle identification number under the provisions of regulation 67(3) of the Road Vehicles (Construction & Use) Regulations 1986).

    (3) Where a person who carries on the business of a motor salvage operator purchases for less than £100 a motor vehicle whose engine and chassis or frame are over 10 years old, he shall not be obliged by such regulations as may be made under section 8(1) to notify the destruction of the motor vehicle.

    (4) Where a person carries on the business of a motor salvage operator in whole or part on domestic premises, the right of a constable to enter and inspect premises under section 9(1) shall not extend to the domestic premises.'.


Offences of supplying registration plates for unlawful purposes

    '.—(1) A person who supplies a registration plate to another person when he knows or reasonably suspects that it will be used for an unlawful purpose shall be guilty of an offence.

    (2) A person guilty of an offence under subsection (1) shall be liable on summary conviction to a fine not exceeding level 5 of the standard scale.'.

    'After section 27 of the Vehicle Excise and Registration Act 1994 (registration marks) there shall be inserted—

"Provisions relating to regional symbols

    (27A)(1) The Secretary of State shall prescribe no specifications that require a registration plate to contain or display any flag or symbol of the European Union.

    (2) Notwithstanding subsection (1), the Secretary of State shall by regulations provide for any registration plate to contain or display a flag specified by the owner of the relevant vehicle.".'.


Right to enter and inspect premises (No. 1)

    '(1) A justice of the peace may issue a warrant authorising a constable or (as the case may be) an authorised person to enter and inspect premises, provided that admission to the premises is reasonably required to secure compliance with the provisions of this Part, or to ascertain whether these provisions are being complied with.

    (2) A constable or an authorised person may, if necessary, use reasonable force in the exercise of his powers under a warrant issued under subsection (1).

    (3) A constable or an authorised person may at any reasonable time—

    (a) require production of, and inspect, any registration plates kept at the premises; and

    (b) require production of, inspect and take copies of or extracts from any records which the person carrying on business as a registration plate supplier is required to keep at such premises by virtue of this Part.

    (4) A constable or an authorised person in seeking to enter any premises in the exercise of his powers under a warrant issued under subsection (1) shall, if required by or on behalf of the owner or occupier or person in charge of the premises, produce evidence of his identity, and of his authority for entering before doing so.

    (5) Any person who obstructs an authorised person in the exercise of his duties under a warrant issued under subsection (1) shall be guilty of an offence and liable on summary conviction to a fine not exceeding level 2 on the standard scale.'.

    'After section 2 of the Refuse Disposal (Amenity) Act 1978 there shall be inserted—

    "2A. The Secretary of State shall make provision for any revenue raised as a result of an offence committed under subsection 2(1a) above to be provided to a local authority as an additional resource for the purposes of complying with the provisions of section 3(1) below".'.

    That the following provisions shall apply to the Vehicles (Crime) Bill:

Standing Committee

    1. The Bill shall be committed to a Standing Committee.

    2. Proceedings in the Standing Committee shall (so far as not previously concluded) be brought to a conclusion on Tuesday 23rd January 2001.

    3. The Standing Committee shall have leave to sit twice on the first day on which it shall meet.


ORDER OF THE COMMITTEE (PROGRAMMING) (9th JANUARY 2001 AS AMENDED ON 16TH JANUARY)

    That—

(1) during proceedings on the Vehicles (Crime) Bill the Standing Committee do meet on Tuesdays at half-past Ten o'clock and between half-past Four o'clock and Seven o'clock and on Thursdays at five minutes to Ten o'clock and between half-past Two o'clock and Five o'clock (save on the afternoon of Tuesday 16th January, when the Committee may sit until half past Nine o'clock, and on the afternoon of Thursday 18th January, when the Committee may sit until Four o'clock)';

    (2) 10 sittings in all shall be allotted to the consideration of the Bill by the Committee;

    (3) the proceedings to be taken on the sittings shall be as shown in the second column of the Table below and shall be taken in the order so shown;

    (4) the proceedings which under paragraph (3) are to be taken on any sitting shall (so far as not previously concluded) be brought to a conclusion at the time specified in the third column of the Table;

    (5) paragraph (3) does not prevent proceedings being taken (in the order shown in the second column of the Table) on any earlier sitting than that provided for under paragraph (3) if all previous proceedings have already been concluded.
