Representation of Gibraltar at Westminster and in the European Union Bill




Provide for representation of Gibraltar by a Member of Parliament, subject to limitations, in the Parliament of the United Kingdom of Great Britain and Northern Ireland; for the inclusion of Gibraltar in a European parliamentary constituency; for the right of the chief minister to petition the House of Commons at the bar of the House; and for related purposes.

BE IT ENACTED by the Queen's most Excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the authority of the same, as follows:-

Election of a Member of Parliament for Gibraltar.     1. - (1) On the same day as a parliamentary election is held in the United Kingdom, registered electors in Gibraltar may vote in an election for a Member of the House of Commons of the Parliament of Great Britain and Northern Ireland who shall be known as the Member of Parliament for Gibraltar.
      (2) Any vacancy for the position of Member of Parliament for Gibraltar occurring between general elections shall be filled in the same manner as a vacancy occurring in a constituency in England or Wales.
Conduct of elections.     2. - (1) The Secretary of State shall, by regulations made by statutory instrument, lay down rules for the conduct of elections in accordance with section 1.
      (2) Returning officers for the purpose of elections conducted in accordance with section 1 shall be appointed by the House of Assembly of Gibraltar.
      (3) Any expenses reasonably and properly incurred by a returning officer in the conduct of an election in Gibraltar in accordance with section 1 shall be charged on and payable out of the Consolidated Fund.
Remuneration and allowances.     3. - (1) The rates of remuneration and allowances payable to a Member of Parliament elected in accordance with section 1 shall be determined by the Secretary of State by order made by statutory instrument.
      (2) There shall be paid out of money provided by Parliament any expenditure attributable to the payment of remuneration and allowances under subsection (1).
