1Message from the Lords,—A Message was brought from the Lords, as follows:—

Regulatory Reform Bill [Lords],—The Lords have passed a Bill to enable provision to be made for the purpose of reforming legislation which has the effect of imposing burdens affecting persons in the carrying on of any activity and to enable codes of practice to be made with respect to the enforcement of restrictions, requirements or conditions; to which the Lords desire the concurrence of this House.

2Regulatory Reform Bill [Lords],—The Regulatory Reform Bill [Lords] was read the first time; and ordered to be read a second time to-morrow and to be printed [Bill 51].

Ordered, That the Explanatory Notes relating to the Regulatory Reform Bill [Lords] be printed [Bill 51–EN].

3High Hedges Bill,—Ordered, That the Explanatory Notes relating to the High Hedges Bill be printed [Bill 13–EN].

4Register of Drug Trafficking Offenders,—Mr Desmond Browne, supported by Fiona Mactaggart, Sandra Osborne, John Robertson, Mr Jim Murphy, Mr Eric Joyce and Mr David Stewart presented a Bill to amend the Misuse of Drugs Act 1971 to establish a register of drug trafficking offenders; to prescribe the circumstances in which, and by whom, the register may be consulted; and for connected purposes: And the same was read the first time; and ordered to be read a second time on Friday 23rd March and to be printed [Bill 50].

5Criminal Defence Service (Advice and Assistance) Bill [Lords],—The Criminal Defence Service (Advice and Assistance) Bill [Lords] was, according to Order, read a second time.

6Criminal Defence Service (Advice and Assistance) Bill [Lords] (Programme),—A Motion was made, and the Question being put, That the following provisions shall apply to the Criminal Defence Service (Advice and Assistance) Bill [Lords]:

Standing Committee

1. The Bill shall be committed to a Standing Committee.

2. The Standing Committee shall have leave to sit twice on the first day on which it shall meet.

3. Proceedings in the Standing Committee shall (so far as not previously concluded) be brought to a conclusion on Thursday 8th March.

Consideration and Third Reading

4. Proceedings on consideration shall (so far as not previously concluded) be brought to a conclusion at six o'clock on the day on which those proceedings are commenced or, if that day is a Thursday, at three o'clock on that day.

5. Proceedings on Third Reading shall (so far as not previously concluded) be brought to a conclusion at seven o'clock on the day on which those proceedings are commenced or, if that day is a Thursday, at four o'clock on that day.

6. Sessional Order B (Programming Committees) made by the House on 7th November 2000 shall not apply to proceedings on consideration and Third Reading.

Lords Messages

7. Paragraphs (6) and (7) of Sessional Order A (varying and supplementing programme motions) made by the House on 7th November 2000 shall not apply to proceedings on any motion to vary or supplement this order for the purpose of allocating time to proceedings on consideration of any messages from the Lords, and the question on any such motion shall be put forthwith—(Mr David Lock);

7Constitutional Law,—A Motion was made, and the Question being put forthwith, pursuant to Standing Order No. 118 (Standing Committees on Delegated Legislation), That the draft Scotland Act 1998 (Transfer of Functions to the Scottish Ministers etc.) Order 2001, which was laid before this House on 1st February, be approved—(Mr David Jamieson):—It was agreed to.

8Transmissible Spongiform Encephalopathies,—A Motion was made, and the Question being put forthwith, pursuant to Standing Order No. 119 (European Standing Committees), That this House takes note of European Union Document No. 5196/99, a draft regulation of the European Parliament and of the Council laying down the rules for the prevention and control of certain transmissible spongiform encephalopathies, and a draft directive of the European Parliament and of the Council amending Council Directive 91/68/EEC; and supports the Government's objective of achieving Community-wide measures against transmissible spongiform encephalopathies, especially in the light of recent findings that BSE is more widespread in Europe than had previously been acknowledged—(Mr David Jamieson):—It was agreed to.

9Line of Route,—A Motion was made, and the Question being proposed, That this House approves the First Report from the Administration Committee on the Trial Summer Re-opening of the Line of Route (House of Commons Paper No. 213)—(Mrs Marion Roe);

And it being Ten o'clock, the Debate stood adjourned.

10Business of the House,—A Motion was made, and the Question being put forthwith, pursuant to Standing Order No. 15 (Exempted business), That, at this day's sitting, the Motion relating to the Line of Route may be proceeded with, though opposed, until any hour—(Mr Clive Betts):—It was agreed to.

Another Amendment (No. 77) proposed to the Bill, in page 3, line 2, at the end, to insert the words—

‘Hunting which begins and ends in Scotland

.—(1) Subject to sub-paragraph (3), a person does not commit an offence under paragraph 1 if he hunts a wild mammal with a dog in England only incidentally in the course of a hunt which begins and ends in Scotland.

(2) A hunt begins in Scotland if the pursuit of the wild mammal begins in Scotland.

(3) A hunt ends—

(a) when the wild mammal is killed, or

(b) by a decision to stop hunting

and no offence is committed under paragraph 1 if the hunt begins in Scotland and the wild mammal is killed in England.

(4) A wild mammal may not be dug out or bolted in England in the course of a hunt which begins and ends in Scotland.

‘.—(1) The Secretary of State shall by order make a scheme for the making of payments to persons in respect of losses incurred by them as a result of—

(a) ceasing, by reason of the enactment or coming into force of this Act—

(i) to carry on their businesses so far as they consist of activities prohibited by this Act, or

(ii) to continue in paid employment so far as that employment was dependent on activities prohibited by this Act;

(b) damage by wild mammals which were previously controlled by activities prohibited by this Act.

(2) A scheme may, in particular—

(a) specify the descriptions of losses and businesses in respect of which payments are, or are not, to be made and the basis of valuation for determining losses,

(b) specify the amounts of the payments to be made or the basis on which such amounts are to be calculated,

(c) provide for the procedure to be followed (including any time within which claims must be made and the provision of information) in respect of claims under the scheme and for the determination of such claims,

(d) include provision for arbitration of any dispute as to a person's entitlement to payments under the scheme or the amounts of any such payments.

(3) Before making a scheme under this paragraph, the Secretary of State shall consult such organisations as appear to him to represent persons likely to be entitled to payments under such a scheme.

(4) An order under this paragraph shall be made by statutory instrument which shall be subject to annulment in pursuance of a resolution of either House of Parliament.'.—(Mr Lembit Opik.)

Foot and Mouth and the Crisis in Agriculture,—Resolved, That this House expresses concern about the recent outbreak of foot and mouth disease, sympathy for farmers facing the loss of their livelihoods and for others working in the livestock sector, and appreciation of the work of those fighting to contain the spread of the disease; endorses the action of the Government to restrict the movement of livestock; welcomes its efforts to identify the source of the outbreak; urges, where necessary, a temporary suspension of rights of way across farmland; welcomes the Government's announcement that it will draw down the full amount of agri-monetary compensation available for livestock farmers; and calls on the Government to consider what other help can be given to the industry.—(Mr Tim Yeo.)
