SCHEDULE 1

Rights to appoint voters

Part 1

QUALIFYING BODIES: SCALE OF APPOINTMENTS

1    Subject to the following paragraphs of this Schedule, the number of persons which a qualifying body may appoint for the purpose of section 3(1)(c) shall be calculated in accordance with the following scale:
Rateable value of hereditament occupied by qualifying body Maximum number of persons whom that body may appoint
£200 up to £20,0001.
Over £20,000 but not over1 for every complete £20,000 of that
£1,000,000rateable value, plus 1 for any further amount thereof less than £20,000.
Over £1,000,000100 for the first £1,000,000 of that rateable value, plus—
(a) 1 if that rateable value exceeds £1,000,000 by less than £100,000;
(b) if that rateable value exceeds £1,000,000 by £100,000 or more, 1 for every complete £100,000 of that excess, plus 1 for any further amount of that excess less than £100,000.
2    Where a qualifying body is in occupation of more than one hereditament in the same ward, the number of persons eligible for appointment in accordance with paragraph 1 shall be ascertained by aggregating the rateable value of those hereditaments.
3    Where paragraph 2 above applies, the references in section 3(6) and section 5(5) to the hereditament in respect of which the entitlement to appoint arises shall be treated as references to any of the hereditaments whose rateable values have been aggregated.
4    On the first occasion after the passing of this Act on which the local non-domestic rating list is compiled in accordance with the requirements of section 41 of the Local Government Finance Act 1988 (c. 41), and for the whole of the period for which that list remains in force in accordance with the provisions of that section, any reference to a rateable value referred to in section 3 or in paragraph 1 of this Schedule shall be treated as a reference to that rateable value adjusted (to the nearest five pounds) in accordance with the formula--
    A / B × C
5    In paragraph 4 above—
(a)    A is the total rateable value of all hereditaments shown in the local non-domestic rating list as compiled on that occasion;
(b)    B is the total rateable value of all hereditaments shown in the local non-domestic rating list in force when this Act is passed as originally compiled; and
(c)    C is a rateable value referred to in section 3 or in paragraph 1 of this Schedule.
6    The provisions of paragraph 4 above also apply to each subsequent occasion after the passing of this Act on which the local non-domestic rating list is compiled as they apply to the first occasion after the passing of this Act on which that list was compiled; and accordingly in relation to any such subsequent occasion—
(a)    A shall be taken to be the total rateable value of all hereditaments shown in the local non-domestic rating list as compiled on that occasion;
(b)    B shall be taken to be the total rateable value of all hereditaments shown in the local non-domestic rating list which that list supersedes, at the time when the superseded list was compiled; and
(c)    C shall be taken to be a reference to a rateable value referred to in section 3 or in paragraph 1 of this Schedule as adjusted under paragraph 4, or paragraph 4 and this paragraph, on the last occasion on which the list was compiled.
7    If this Act is passed on or after lst April 2000—
(a)    any reference in this Part of this Schedule to the first occasion after the passing of this Act on which the local non-domestic rating list is compiled shall be treated as a reference to lst April 2000; and
(b)    any reference to the local non-domestic rating list in force when this Act is passed shall be treated as a reference to the local non-domestic rating list which was superseded by the list compiled on lst April 2000.

Part 2

MULTIPLE OCCUPATION

8    Where two or more persons are in occupation of part of a hereditament in relation to which section 3(1)(a) applies, those persons may, by written nomination signed by each of them, appoint one person to vote.
9    Where a qualifying body is in sole occupation of part of a hereditament in relation to which section 3(1)(c) applies, the qualifying body may, by written nomination signed by a duly authorised person on its behalf, appoint one person to vote.
10    Where two or more qualifying bodies are in occupation of part of a hereditament in relation to which section 3(1)(c) applies, those qualifying bodies may, by written nomination signed by each of them, appoint one person to vote.
11    Where two or more persons are in occupation of the whole of a hereditament in relation to which section 3(1)(a) applies, or two or more qualifying bodies are in occupation of the whole of a hereditament in relation to which section 3(1)(c) applies, the maximum number of persons entitled to vote or eligible for appointment pursuant to the provision in question shall be the number obtained by dividing the rateable value of the hereditament so occupied as shown on the local non-domestic rating list by the figure referred to in section 3(1) as the required minimum rateable value of a hereditament shown in the local non-domestic rating list, ignoring any remainder.
12    Where paragraph 11 above applies and the number of persons or qualifying bodies in occupation of the hereditament exceeds the maximum figure resulting from that paragraph, the entitlement of any person to vote shall be subject to a written nomination signed by each person or qualifying body in occupation of the hereditament.
13    Where, apart from this paragraph, section 3(1)(a) and 3(1)(c) would both apply in relation to the same hereditament or part of a hereditament, only section 3(1)(a) shall apply in relation to that hereditament or part.

Part 3

EXEMPT HEREDITAMENTS: PLACES OF RELIGIOUS WORSHIP ETC

14        Where a hereditament occupied by a qualifying body is exempt by reason of paragraph 11 (exemption from rates for places of religious worship etc) of Schedule 5 to the Local Government Finance Act 1988, the qualifying body may appoint one person as a voter under section 3(1)(c) of this Act.
