DECISIONS BETWEEN 1 JANUARY AND 31 DECEMBER 1999 TO REFUSE OR UPHOLD AN APPEAL AGAINST A DECISION TO REFUSE AN APPLICATION OR REVOKE A LICENCE

  The Committee asked the Government to provide details of the appeals within the period covered by the Report against (i) a decision to refuse an application for a standard individual export licence (SIEL) or an Open Individual Export Licence (OIEL), or (ii) to revoke a SIEL or OIEL.

  As noted in the memorandum submitted to the Committee by the Foreign and Commonwealth Office on the roles and responsibilities of the main departments involved in the licensing process (HC540, pp 80-86), there is no provision in the licensing procedure for a formal appeal against decisions to refuse or revoke an OIEL. Such decisions do not prevent a company from applying for a SIEL covering some or all of the same goods to any of the destinations concerned; the factors that led to the original decision would obviously be taken into account in the decision on any such application.

  For the period covered by the 1999 Annual Report, the Export Control Organisation did not maintain a central record of appeals against decisions to refuse or revoke a SIEL. Nevertheless, 25 appeals against the original decision to refuse an application for an SIEL have been identified; and no appeals against a decision to revoke such a licence. The appeal against the original decision on 18 applications was rejected; the appeal against the original decision on application Nos 548729, 550019, 548860, 546084, 546181 & 545773 were upheld and a licence issued.

  The applicants are being informed that the Committee might approach them, and that information on the relevant decisions has been provided in confidence to the Committee at Annex E.[2]
