EXCLUSIONS FROM SCOPE OF LEGAL AID IN ENGLAND
AND WALES
1. Schedule 2 to the Access To Justice Act
1999 sets out the services which may not be funded as part of
the Community Legal Service. Paragraph 1(b) of Schedule 2 to the
Access to Justice Act 1999 specifically excludes boundary disputes
from receiving funding as part of the Community Legal Service.
2. The Lord Chancellor has issued guidance,
under section 23 of the Access to Justice Act 1999, to the Legal
Services Commission explaining the Government's intentions underlying
paragraph 1 of Schedule 2 to the Act. The Lord Chancellor's guidance
indicates that the areas of law excluded by paragraph 1 are excluded
"because they are not considered to have sufficient priority
to justify public funding."
