SUPPLEMENTARY MEMORANDUM FROM THE SCOTTISH ENVIRONMENT PROTECTION AGENCY (SEPA)

Extract from a Letter from Ms Patricia Henton, Chief Executive, SEPA, to the Committee

  I hope the evidence we gave was helpful to the Committee. There is one point which I would like to reinforce in respect of what I think might be a misunderstanding over the so-called exemption from licencing of abstraction. Dr Curran quoted from Article 11(e) of the Water Framework Directive (paragraph 575) of the transcript which makes it clear that there is no overall exemption from abstraction licencing, only a provision that if there is no significant ecological damage caused then there may be an exemption. I would be grateful if you would reinforce this point with the Committee.

  I enclose copies of information which was promised in respect of Islay, our charging schemes and the Dumfries Aquifer. I hope that this is useful and we would be pleased to supply further information if you require it.
