       'Where the European Scrutiny Committee reports that a matter within its terms of reference should be debated on the floor of the House of Commons it shall be a contempt of the House for any Member or Minister of the Crown not to comply with that requirement.'.


Compliance with European Scrutiny Reserve

       'Where the European Scrutiny Committee has imposed a reserve on a European legislative proposal it shall be a contempt of the House for any Minister of the Crown to vote on that proposal in the Council of Ministers whilst that reserve subsists.'.

'.—This Act shall not take effect prior to the laying before Parliament of a draft Order making provision for the ascertaining by the Government of the preponderance of national opinion with respect to the Nice Treaty by means of a referendum (providing that the Order shall not be made until provision from public funds has been made by Parliament in respect of expenditure incurred in the undertaking of such a referendum).'.

       'In section 2(3) of the European Parliamentary Elections Act 1978 (electoral regions and number of MEPs), there shall be added at the end: "and the allocation of the United Kingdom's seats following the ratification of the Treaty of Nice will be such as to ensure that 8 MEPs continue to be elected for Scotland and 5 MEPs continue to be elected for Wales".'.


Rights of Scottish Executive and Welsh Administration to refer to European Court of Justice

To move the following Clause:—

       'For the purposes of section 2(2)(a) (general implementation of Treaties) and Part 2 of Schedule 1 (definitions relating to Communities' other definitions) to the European Communities Act 1972 any reference to a United Kingdom right in relation to the European Court of Justice shall include a right of the Scottish Executive and Welsh Administration to refer directly to the European Court of Justice when their prerogatives have been harmed.'.

EUROPEAN COMMUNITIES (AMENDMENT) BILL (PROGRAMME) (No. 2)

       That, in accordance with the resolution of the Programming Committee of 10th July and pursuant to the Programme Order of 4th July 2001 (proceedings in Committee of the whole House, on consideration and on Third Reading of the European Communities (Amendment) Bill),—

    (1)   proceedings in Committee of the whole House shall, so far as not previously concluded, be brought to a conclusion at 10.00 p.m. on the third allotted day (or, if that day is a Thursday, 7.00 p.m.);

    (2)   those proceedings shall be taken on each of the allotted days as shown in the second column of the following Table and shall be taken in the order so shown, and shall be brought to a conclusion (so far as not previously concluded) at the times specified in the third column of the Table.
