'.(1) Before determining the number of members of OFCOM under section 1(2), appointing the chairman and other non-executive members of OFCOM under section 1(3), and exercising his power under section 1(7), the Secretary of State shall submit a draft of his proposals to relevant committees and shall have regard to any reports they make on those proposals.
(2) If any relevant committee recommends that any draft proposal of the Secretary of State submitted under subsection (1) should not be proceeded with, the Secretary of State shall be required to modify or abandon his draft proposal.
(3) Any modified draft proposal arising from subsection (2) shall be regarded as a new draft proposal for the purposes of subsection (1).
(4) For the purposes of this section a "relevant committee" is a Select Committee of either House of Parliament, or a Joint Committee of both Houses of Parliament, designated by the Secretary of State.'.

'(1) The Secretary of State shall, within one year of the coming into force of section 2 of this Act, prepare a report on the impact on the regulation of the BBC of any relevant proposals about the regulation of communications.
(2) The Secretary of State shall lay a copy of the report before both Houses of Parliament.'.
Promotion of investment in communications infrastructure
