    (2) But sub-paragraph (1) does not apply in relation to a defendant (within the meaning of Part 4 of that Act) in the following proceedings—

        (a)   proceedings mentioned in head (b) of that sub-paragraph;

        (b)   an application under section 228 for the payment of compensation if the confiscation order was varied under section 186."

Operation of the Act in Scotland: reports and review

To move the following Clause:—

    '(1)   The Lord Advocate must, as soon as possible after the end of each financial year, publish a report on how he has exercised his functions under Part 3 and under Chapter 3 of Part 5 during the financial year.

    (2)   The Scottish Ministers must, as soon as possible after the end of each financial year, publish a report on how they have exercised their functions under Part 5 during the financial year.

    (3)   Within a period of two years after the coming into force of Part 5 of this Act, the Lord Advocate and the Scottish Ministers must publish jointly a review of the operation of the Act (other than Part 6) in Scotland, including their opinions on the case for the establishment of a Scottish Assets Recovery Agency.

    (4)   A report under subsection (1) or (2) or a review under subsection (3) must be laid before the Scottish Parliament.'.

       'For the purposes of section 75, the following are criminal lifestyle offences:

(a) people trafficking, in the sense primarily of trafficking for sexual exploitation;

(b) facilitation of immigration offences (including illegal working);

(c) forgery of travel and other immigration-related documents;

      (d) drug trafficking offences;

      (e) money laundering offences;

      (f) conspiracy to defraud the Crown (e.g., benefits, taxation, grants, etc);

      (g) arms trafficking;

      (h) involvement in counterfeit currency and counterfeit goods;

      (i) dealing in child pornography;

      (j) pimping;

      (k) brothel keeping;

      (l) corruption;

      (m) terrorist funding offences;

      (n) insider dealing; and

      (o) murder for gain or attempted murder for gain.'.
