NEW CLAUSES RELATING TO PART 2Discontinuance of proceedings: information for victims
Mr Quentin Davies NC3 *To move the following Clause:'(1) Where the Director has the conduct of proceedings in relation to an offence against a person and he decides to discontinue such proceedings at any stage, he must inform the victim or victims of the offence, or in the event of their being deceased or incapacitated, their next of kin. (2) If, following a court appearance, a person is acquitted at the direction of the court, the Director must inform the victim or victims of the offence, on in the event of their being deceased or incapacitated, their next of kin, of that action.'.
Reasons for discontinuance of proceedings
Mr Quentin Davies NC4 *To move the following Clause:'(1) Where the Director has the conduct of proceedings in relation to an offence against a person and he decides to discontinue such proceedings at any stage, he shall have a duty to provide the Attorney General and the Advocate General with reasons for his decision. (2) The Attorney General shall, if requested by the victims of the offence, or in the event of their being deceased or incapacitated, their next of kin, provide a copy of the reasons referred to in subsection (1) to those people, unless he decides that to do so would be against the interests of justice, or the Advocate General, with whom he shall have a duty to consult, decides that to do so would be against the public interest.'.
