SCHEMES WHICH HAVE BEEN/MAY BE AFFECTED BY PIPS RULING

  It seems to be generally accepted that the EC view that PIP was an illegal state aid effectively ruled out any project in which the private sector sought public sector funding directly (and possibly indirectly).

  The draft SEZ IDPs states that the establishment of a simple and straightforward gap funding mechanism is a "critical success factor" for the management of the Objective 1 Programme—"The success of the Programme depends on the substantial involvement of private sector developers".

EMPLOYMENT SITE PROJECTS (HISTORIC/ONGOING)

J36 SRB infrastructure£1.2 million off site infrastructure project funded by SRB. Committed prior to PIPs decision. Scheme directly benefits three private sector developers and it may not now be possible to do similar schemes.
Dunlop Slazengeragreed prior to PIP ruling but ability to transfer premises development to another user is uncertain.
Land reclamation schemesfor hard afteruse—see briefing note on LRP implications.
Priority Sitesjoint venture (English Partnerships and Royal Bank of Scotland). Have a generic floorspace approval which was agreed prior to PIPs ruling. We are negotiating to secure PS development in Barnsley. Agreement ends in c two years.
