      (d) ensure that the assessment carried out under the above provisions provides sufficient information in the care plan, or make arrangements so that a provider of services to the patient can carry out an appropriate assessment, to satisfy Standards 3 and 4 of the National Minimum Care Standards for Care Homes and Standards 2 and 3 of the Draft National Minimum Care Standards for Domiciliary Care, as required by the Care Standards Act 2000.

    (3A)   Where, for the purposes of satisfying the fitness for purpose of proposed accommodation under the Care Standards Act 2000, the assessment procedure exceeds three days, the delayed discharge period shall be disapplied.'.

    '(3A)   Before making a decision under subsection (3) the responsible authority must—

      (a) consult the patient and his carer, if he has one;

      (b) inform them of the cost of the proposed care plans; and

      (c) obtain the consent of the patient and any carer and—

            (i)   where informal consent is given, record that on the patient's file, or

            (ii)   in the case where a patient lacks the mental capacity to give such consent, record on the file what steps if has taken to ensure that the patient's best interests have been duly considered.'.

    '(4A)   If by the end of the relevant day it has not been possible to discharge the patient due to a failure to make available an NHS service, such as community nursing services, required for safe discharge under the aftercare plan, the responsible NHS body must make a payment of an amount prescribed in regulations for each day of the delayed discharge period.

    (4B)   Where a patient discharged is then re-admitted within three weeks of the prescribed period, and it can be shown—

      (a) that the assessment of the patient's needs should have indicated that it would not be safe to discharge him, notwithstanding the availability of community care services under section 3(3)(b), or

      (b) that the NHS body failed to withdraw the notice under section 3(5), the responsible NHS body must make a payment of an amount prescribed in regulations for each day of the additional stay in hospital beyond the delayed discharge period.'
