The Amendments have been arranged in accordance with the Order of the Committee [11th June], as follows:—

NEW CLAUSE 1

Annual reports on progress towards sustainable energy aims

To move the following Clause:—

    '(1)   The Secretary of State must in each calendar year, beginning with 2004, publish a report ("a sustainable energy report") on the progress made in the reporting period towards—

      (a) cutting the United Kingdom's carbon emissions;

      (b) maintaining the reliability of the United Kingdom's energy supplies;

      (c) promoting competitive energy markets in the United Kingdom; and

      (d) reducing the number of people living in fuel poverty in the United Kingdom.

    (2)   "The reporting period", for the purposes of subsection (1), means the year ending with 23 February in the calendar year in question.

    (3)   Accordingly, the report must be published in that calendar year within the period beginning with 24 February and ending with 31 December ("the publication period").

    (4)   A sustainable energy report may either be published as a single report or published in a number of parts during the publication period, and any such report or part may be contained in a document containing other material.

    (5)   A sustainable energy report must be based on such information as is available to the Secretary of State when the report is completed (except that if it is published in parts, each of those parts must be based on such information as is so available when that part is completed).

    (6)   For the purposes of this section a person is to be regarded as living in fuel poverty if he is a member of a household living on a lower income in a home which cannot be kept warm at a reasonable cost.'.

      (iv) reductions in emissions of carbon dioxide of 60% based on 1990 levels by 2050;

      (v) carbon savings as a result of measures to improve domestic energy efficiency of 5 MtC by 2010 and a further 4 MtC by 2020.'.

    '(7)   In this section—

"the appropriate authority" means—(a) in relation to England, the Secretary of State; and(b) in relation to Wales, the National Assembly for Wales;"energy conservation authority" has the same meaning as in the Home Energy Conservation Act 1995 (c.10); and"sustainable energy policy" means measures which reduce emissions of carbon and methane and promote reductions in the use of energy, and, for the avoidance of doubt, does not include nuclear power.'.

To move the following Clause:—

    '(1)   For the purpose of developing and promoting a sustainable energy policy the Secretary of State shall, taking into account any likely costs, take reasonable steps to achieve the objectives for the time being from domestic energy efficiency that are specified in his current policy document and those steps may include.

      (a) encouraging energy conservation authorities to implement measures in their energy conservation reports drawn up pursuant to the Home Energy Conservation Act 1995 (c. 10)

      (b) issuing further guidance to energy conservation authorities pursuant to the Home Energy Conservation Act 1995

      (c) progressively raising efficiency standards of boilers

      (d) promoting improved heating controls

      (e) insulating cavity walls

      (f) improved standards of new build and refurbishment through revisions to the building regulations:

      (g) community heating with CHP;

      (h) the promotion of micro CHP; and

      (i) making arrangements with the devolved administrations and such arrangements may include levels of carbon savings to be achieved in the areas of those administrations.

    (2)   If, in the opinion of the Secretary of State, he has insufficient resources to enable the objectives for the time being specified in his current policy document to be achieved, he shall publish a report to this effect giving the reasons for that opinion and he shall lay any such report before Parliament.

    (3)   For the purposes of this section—

      (a) the "current policy document" means the Energy White Paper presented to Parliament in February 2003, Cm 5761; and

      (b) the "objectives for the time being" are 5 MtC carbon savings by 2010 and a further 4 MtC by 2020.

    (4)   The Secretary of State may by Order amend or change

      (a) the current policy document

      (b) the objectives for the time being

      (c) the way in which those objectives are expressed.

    (5)   In this section and section (energy conservation authorities) a "sustainable energy policy" means 'measures which reduce emissions of carbon and methane and promote reductions in the use of energy and, for the avoidance of doubt, does not include nuclear power.".'.

To move the following Clause:—

    '(1)   For the purpose of developing and promoting a sustainable energy policy the appropriate authority may, after consulting with representatives of local government, from time to time publish targets for the level of improvement in energy efficiency in residential accommodation to be achieved by energy conservation authorities by 2010.

    (2)   The appropriate authority may publish different targets for different authorities.

    (3)   The appropriate authority may publish targets for a single authority only or for some authorities.

    (4)   An energy conservation authority for which a target has been published may resolve to adopt that target and in such case it shall be the duty of that authority to implement measures in order to achieve that target.'

    (5)   In section the "appropriate authority" is

      (a) in relation to England, the Secretary of State;

      (b) in relation to Wales, the National Assembly for Wales.'.
