To

Make further provision relating to litter and the fouling of land by dogs and to

allow a local authority to retain the revenue from fixed penalty notices for

such offences issued in its area for the purposes of enforcement.                                                                            

Be it enacted by the Queen’s most Excellent Majesty, by and with the advice and

consent of the Lords Spiritual and Temporal, and Commons, in this present

Parliament assembled, and by the authority of the same, as follows:—

 1     Retention and use of revenue from fixed penalty notices

Section 88 (fixed penalty notices for leaving litter) of the Environmental

Protection Act 1990 (c. 43) is amended as follows—

           (a)           in subsection (6) (a) by substituting for the words ‘paid to the Secretary

of State’ the words ‘retained by that authority’.

           (b)           in subsection 6) by the addition of subsection (6) (c) “shall be used by

that authority for the purpose of enforcement of the provisions of

Sections 87 and 88 of the above Act.”

 2     Short title, commencement and extent

     (1)    This Act may be cited as the Litter and Fouling of Land by Dogs Act 2003.

     (2)    This Act shall come into force three months after it receives Royal Assent.

     (3)    This Act extends to England and Wales only.
