To

ban the manufacture, sale or use of collars which administer electric shocks to

animals.                                                                            

Be it enacted by the Queen’s most Excellent Majesty, by and with the advice and

consent of the Lords Spiritual and Temporal, and Commons, in this present

Parliament assembled, and by the authority of the same, as follows:—

 1     Prohibition on use, etc. of electric animal collars etc.

     (1)    It shall be an offence for any person to use, procure or permit the use of any

electric collar or similar device on any animal.

     (2)    It shall be an offence for any person to have in his possession or under his

control, or to offer, expose or advertise for sale, any electric collar or similar

device designed or intended for use on any animal.

     (3)    A person guilty of an offence under this section shall be liable, on summary

conviction, to a fine not exceeding level 5 on the the standard scale.

 2     Forfeiture

Where a person is convicted under section 1 of this Act, the court may, in

addition to any other penalties imposed, order the confiscation of any electric

collar or similar device with which, or in respect of which, the offence was

committed.

 3     Definitions

In this Act—

                      “animal” has the same meaning as in section 15 of the Protection of

Animals Act 1911 (c. 27) (definitions);

                      “electric collar or similar device” means any collar or device which is

made, designed or adapted to transmit electric current or other electric

impulse to cause shock, pain or other stimulus to an animal wearing, or

otherwise in contact with, the collar or device;

                      “sale” includes hire, barter and exchange, and related expressions shall be

construed accordingly.

 4     Citation and extent

     (1)    This Act may be cited as the Animals (Electric Shock Collars) Act 2003.

     (2)    This Act does not extend to Northern Ireland or Scotland.
