      'Research and observation

    (1) The hunting of a wild mammal is exempt if the conditions in this paragraph are satisfied.

    (2) The first condition is that the hunting is undertaken for the purpose of or in connection with the observation or study of the wild mammal.

    (3) The second condition is that the hunting does not involve the use of more than two dogs.

    (4) The third condition is that the hunting does not involve the use of a dog below ground.

    (5) The fourth condition is that the hunting takes place on land—

            (a)   which belongs to the hunter, or

            (b)   which he has been given permission to use for the purpose by the occupier or, in the case of unoccupied land, by a person to whom it belongs.

    (6) The fifth condition is that each dog used in the hunt is kept under sufficiently close control to ensure that it does not injure the wild mammal.'.

'Shooting

    8     (1)   A person does not commit an offence if a dog flushes, pursues or kills a wild mammal in the course of walked up or driven shooting where that person had no intention to hunt or kill a wild mammal even though it was forseeable that a dog may hunt a wild mammal.

    (2)   For the purposes of this paragraph "a dog" means one or more dogs.'.

Drag hunting

    8   A person who participates in a drag hunt does not commit an offence if a dog flushes or hunts a wild mammal, even where that flushing or hunting was a forseeable possibility, unless, having the responsibility for the control of the dog, he does not take reasonable steps to control the dog once the wild mammal has been flushed or hunted.'.

    8   A person who walks a dog for that person's own exercise or pleasure or that of the dog does not thereby commit an offence if the dog flushes or hunts a wild mammal, even where that flushing or hunting was a forseeable, but unavoidable, consequence of dog walking, unless that person does not take reasonable steps to control the dog once the wild mammal has been flushed or hunted.'.

       'Orphaned fox cubs

    8 (1)   Using a dog below ground to search for fox cubs is exempt hunting if the conditions in this paragraph are satisfied.

    (2)   The first condition is that the hunter reasonably believes that the cubs are not capable of fending for themselves and that their mother is dead or seriously injured.

    (3)   The second condition is that reasonable steps are taken for the purpose of ensuring that as soon as possible after being found the fox cubs are shot dead or otherwise cared for.'.

HUNTING BILL (PROGRAMME) (No. 3)

That the programme order of 16th December 2002 in relation to the Hunting Bill be varied as follows—

    1. Paragraph 4 of the order shall be omitted.

    2. Proceedings on consideration shall (so far as not previously concluded) be brought to a conclusion five and a half hours after the commencement of proceedings on the motion for this order.

    3. Proceedings on consideration shall be taken in the following order—

            (a)   New Clause 13 and any new clauses and amendments which stand to be grouped for debate with it;

            (b)   New Clause 12 and any new clauses and amendments which stand to be grouped for debate with it;

            (c)   Remaining proceedings.

    4. At the conclusion of proceedings on consideration, the question on any motion made by a Minister of the Crown to re-commit the Bill to a Standing Committee shall be put forthwith.
