Belfast (No. 2)

To move the following Clause:—

    '(1)   Schedule [Belfast (No. 2)] makes provision in relation to Belfast.

    (2)   Subsection (1) comes into force in accordance with provision made by the Secretary of State by order.'.


Exceptions to limits on complaints and references to Ombudsman

To move the following Clause:—

       'In section 64 of the Police (Northern Ireland) Act 1998 (c. 32) (regulations) after subsection (2A) there shall be inserted—

      "(2B) The Secretary of State may only prescribe exceptions pursuant to subsection (2A) above if the circumstances are both grave and exceptional.".'.


Appointments to the Police Service of Northern Ireland

To move the following Clause:—

       'In the event that—

      (a) the Chief Constable is unable to appoint his required number of police trainees or police support staff, or

      (b) the number of serving officers is below that intended at the time of consideration

       the Secretary of State shall, at the request of a majority of the Police Board and acting on the recommendation of the Chief Constable, make an Order to suspend the provisions of section 46 of the Police (Northern Ireland) Act 2000 (c. 32) for a period of six months.'.


Independent members of district policing partnerships

To move the following Clause:—

    '(1)   Paragraph 4 of Schedule 3 to the Police (Northern Ireland) Act 2000 (c. 32) (independent members) is amended as set out in subsections (2) and (3).

    (2)   After sub-paragraph (1) insert—

      "(1A) No person may be appointed an independent member pursuant to sub-paragraph (1) above unless the Board make a declaration that the Board is satisfied that the person is not involved in any paramilitary organisation or in organised crime."

    (3)   After sub-paragraph (1A) insert—

      "(1B) Before making a declaration under sub-paragraph (1A) above the Board must consult the district commander for the local policing district.".'.


Political members of district policing partnerships

To move the following Clause:—

    '(1)   Paragraph 3 of Schedule 3 to the Police (Northern Ireland) Act 2000 (c. 32) (political members) is amended as set out in subsections (2) and (3).

    (2)   After sub-paragraph (1) insert—

      "(1A) No person may be appointed a political member pursuant to sub-paragraph (1) above unless the Board make a declaration that the Board is satisfied that the person is not involved in any paramilitary organisation or in organised crime."

    (3)   After sub-paragraph (1A) insert—

      "(1B) Before making a declaration under sub-paragraph (1A) above the Board must consult the district commander for the local policing district.".'.


Removal from office of members of district police partnerships

To move the following Clause:—

    '(1)   Paragrpah 7 of Schedule 3 to the Police (Northern Ireland) Act 2000 (c. 32) (removal of members from office) is amended as set out in subsection (2).

    (2)   After sub-paragrpah (1) insert—

      "(1A) The Board must remove a person from office as an independent member of a DPP if at any time after their appointment the Board is no longer satisfied that the person is not involved in any paramilitary organisation or in organised crime and would not make a declaration pursuant to paragraph 4(1A) in respect of that person.

      (1B) The council must remove a person from office as a political member of a DPP if at any time after their appointment the Board recommend to the council that it is no longer satisfied that the person is not involved in any paramilitary organisation or in organised crime and would not make a declaration pursuant to paragraph 3(1A) in respect of that person.".'.


Encouragement of a representative police service

To move the following Clause:—

    '(1)   Part 6 of the Police (Northern Ireland) Act 2000 (c. 32) shall be amended as follows.

    (2)   In section 44 (recruitment arrangements: trainees and support staff), subsections (5) to (7) shall be omitted.

    (3)   For section 46, there shall be substituted—

       "46 A representative police force

       It shall be the duty of the Chief Constable to take all steps he considers appropriate to secure that the Police Service of Northern Ireland, in its composition, represents the population of Northern Ireland."

    (4)   For section 47(1) (meaning of "temporary provisions"), there shall be substituted—

      "(1) In this section "the temporary provisions" means the provisions of section 45.".'.


Disqualification of independent members of district policing partnerships

    '(1)   Paragraph 8 of Schedule 3 to the Police (Northern Ireland) Act 2000 (c. 32) shall be amended as follows.

    (2)   In sub-paragraph (2) the words after "offence" shall be omitted.

    (3)   After sub-paragraph (2) there shall be inserted—

      "(3) The Secretary of State may exempt a person from disqualification under the provisions of sub-paragraph (2) if, in the opinion of the Secretary of State, the offence of which the person was convicted was not such as to render the person unsuitable for membership.".'.


Name of the police in Northern Ireland

    '(1)   Section 1 of the Police (Northern Ireland) Act 2000 (c. 32) (name of the police in Northern Ireland) is amended as follows.

    (2)   In subsection (2) for "Police Service of Northern Ireland" substitute "Police Service—the Royal Ulster Constabulary".

    (3)   In subsection (4) for "The Police Service of Northern Ireland Reserve" substitute "the Police Service Reserve—the Royal Ulster Constabulary".'.


Consultation on codes of practice

       'In section 27 of the Police (Northern Ireland) Act 2000 (c32) (Codes of practice on exercise of functions) for subsection (2) substitute—

    "(2)   Before issuing of revising a code of practice under this section, the Secretary of State shall consult the Board and the Chief Constable with a view to obtaining their agreement to the proposed code of practice or revision.

    (2A)   Before issuing or revising a code of practice under this section, the Secretary of State may also consult—

      (a) the Ombudsman;

      (b) the Northern Ireland Human Rights Commission;

      (c) the Equality Commission for Northern Ireland;

      (d) such other persons as the Secretary of State considers appropriate.".'.

       'In section 24 of the Police (Northern Ireland) Act 2000 (c32) (Secretary of State's long term policing objectives) for subsection (2) substitute—

    "(2)   Before determining or revising any objectives under this section, the Secretary of State shall consult the Board and the Chief Constable with a view to obtaining their agreement to the proposed code of practice or revision.

    (2A)   Before determining or revising any objectives under this section, the Secretary of State may also consult—

      (a) the Ombudsman;

      (b) the Northern Ireland Human Rights Commission;

      (c) the Equality Commission for Northern Ireland;

      (d) such other persons as the Secretary of State considers appropriate.".'.

       'In paragraph 8 to Schedule 3 of the Police (Northern Ireland) Act 2000 (c. 32) (Disqualification) for subparagraph (2) substitute—

          "(2)   A person is disqualified from being an independent member of a DPP if he has at any time been convicted in Northern Ireland or elsewhere of any offence and has had passed on him a sentence of imprisonment (whether suspended or not) of more than twelve months.

          (2A)   A person is disqualified from being an independent member of a DPP if, in the opinion of a police officer of superintendent rank or above, he is connected with a paramilitary organisation listed in Schedule 2 of the Terrorism Act 2000.

          (2B)   A person is disqualified from being an independent member of a DPP if, in the opinion of a police officer of superintendent rank or above, he is connected with a paramilitary organisation specified under section 3(8) of the Northern Ireland Sentences Act 1998.".'


Police consultation over eligibility of independent members of a DPP

       'In paragraph 4 of Schedule 3 to the Police (Northern Ireland) Act 2000 (c. 32) (Independent members) after sub-paragraph (1) insert—

          "(1A)   Before approving the appointment of an independent member of a DPP from among persons nominated by the council in accordance with paragraph 5 the Board shall consult a police office of superintendent rank or above as to the eligibility for membership of any individual so nominated.

          (1B)   If a police officer makes a determination as set out in paragraph 8(2A) or (2B) to Schedule 3 the Board must not approve the nomination.".'
