prohibit
the keeping of laying hens in enriched cages.

Be
it enacted by the Queen’s most Excellent Majesty, by and
with the advice and
|
|
consent of the Lords Spiritual and
Temporal, and Commons, in this present
|
|
Parliament assembled, and by the authority
of the same, as follows:—
|
|
1 Protection
of hens
|
|
(1) Section
1 of the Agriculture (Miscellaneous Provisions) Act 1968 (c. 34)
shall be
|
|
amended as follows.
|
|
(2) After
subsection (2), there shall be inserted—
|
|
“(3) A
person commits an offence if without lawful authority or excuse
|

(proof
of which shall lie on him) he keeps, or knowingly causes or
|
|
permits
to be kept, any laying hen in an enriched cage.
|
|
(4) In
this section—
|
|
“enriched
cage” means a cage referred to in Chapter III of Council
|
|
Directive
1999/74/EC of 19 July 1999 laying down minimum
|

|
standards
for the protection of laying hens; and
|
|
“laying
hen” means a hen of the species Gallus
gallus which has
|
|
reached
laying maturity and is kept for production of eggs not
|
|
intended
for hatching.”

2 Short
title, commencement and extent
|

(1) This
Act may be cited as the Welfare of Laying Hens (Enriched Cages) Act
|
|
2003.
|
|
(2) This
Act shall come into force on 1 January 2012.
|
|
(3) This
Act extends to England and Wales only.
|
