Clause     2,     page     3,     line     5,     at end insert—

    '( )   In its application to Northern Ireland, this Act has effect as if—

      (a) for references to the Secretary of State there were substituted references to the Department of Health, Social Services and Public Safety;

      (b) for references to a fire authority or fire authorities there were substituted references to the Fire Authority for Northern Ireland;

      (c) for references to a fire brigade there were substituted references to the fire brigade within the meaning of the Fire Services (Northern Ireland) Order 1984 (S.I.1984/1821 (N.I.11));

      (d) in section 1(1), "made by statutory instrument" were omitted;

      (e) in section 1(2)(b) and (c), "another fire authority or to" were omitted;

      (f) for section 1(7) there were substituted—

          "(7) The power to make an order under this section shall be exercisable by statutory rule for the purposes of the Statutory Rules (Northern Ireland) Order 1979 (S.I. 1979/1573 (N.I. 12)).

          (7A) An order under this section that makes provision authorised by subsection (1)(a) shall be subject to negative resolution within the meaning of section 41(6) of the Interpretation Act (Northern Ireland) 1954 (c.33(N.I.))."'

NEW CLAUSES

Duties of fire brigade members

To move the following Clause:—

       'Every fire brigade member shall carry out all lawful orders and shall at all times punctually and promptly perform all appointed duties and shall attend to all such matters as he may lawfully be instructed to do.'.


Offences

To move the following Clause:—

       'Any person who causes or attempts to cause or does any act calculated to cause disaffection amongst fire brigade members or induces or attempts to induce or does any act calculated to induce any fire brigade member to withhold his services shall be guilty of an offence and liable—

      (a) on summary conviction to imprisonment for a term not exceeding six months or to a fine not exceeding the statutory maximum or both;

      (b) on conviction on indictment to imprisonment for a term not exceeding two years or to a fine or both.'.


Breach of contract

To move the following Clause:—

       'Any fire brigade member who shall have acted in breach of section (Offences) or who shall have withheld his services or otherwise shall be in breach of section (Duties of fire brigade members) shall be deemed to be in breach of his terms and conditions of service and to have terminated his contract of service.'.

ORDER OF THE HOUSE [THURSDAY 8th MAY]

That the following provisions shall apply to the Fire Services Bill—

Committal

    1.   The Bill shall be committed to a Committee of the whole House.

Proceedings in Committee, on consideration and Third Reading

    2.   Proceedings in the Committee, any proceedings on consideration and proceedings on Third Reading shall be completed at one day's sitting.

    3.   Proceedings in Committee and any proceedings on consideration shall (so far as not previously concluded) be brought to a conclusion one hour before the moment of interruption on the day on which those proceedings are commenced.

    4.   Proceedings on Third Reading shall (so far as not previously concluded) be brought to a conclusion at the moment of interruption on that day.

Programming Committee

    5.   Sessional Order B (programming committees) made on 28th June 2001 shall not apply to proceedings in Committee, any proceedings on consideration and proceedings on Third Reading.

Other proceedings

    6.   Any other proceedings on the Bill (including any proceedings on consideration of Lords Amendments or on any further messages from the Lords) may be programmed.


FIRE SERVICES BILL (PROGRAMME) (No. 2)

That the Order of 8th May 2003 (Fire Services Bill (Programme)) shall be varied as follows—

Proceedings in Committee, on consideration and Third Reading

    1.   Paragraphs 3 and 4 of the Order shall be omitted.

    2.   Proceedings in Committee and any proceedings on consideration shall (so far as not previously concluded) be brought to a conclusion five and a half hours after the commencement of proceedings on the Motion for this Order.

    3.   Proceedings on Third Reading shall (so far as not previously concluded) be brought to a conclusion six and a half hours after the commencement of proceedings on the Motion for this Order.
