      (a) in pursuance of the performance by the Secretary of State of the duties under sections 1, 3 and 51 of the National Health Service Act 1977 (c.49) (duty as to health service and services generally and as to university clinical teaching and research);

      (b) consistent with the principle of equality of access to NHS healthcare; and

      (c) consistent with the principle of universality of access to NHS healthcare.

    (2)   The Regulator will, as required by the Health Select Committee, appear before the Health Select Committee of the House of Commons to report on the exercise of his duties.'.
