Monday 13th January 2003.

The House met at half-past Two o'clock.

PRAYERS.

1Opposition Day [2nd allotted day],—It being an allotted day at the disposal of the Leader of the Opposition in pursuance of Standing Order No. 14 (Arrangement of public business), the House proceeded to consider Opposition business.

The Home Secretary's Responsibility for the Criminal Justice System,—A Motion was made, and the Question being proposed, That this House views with great concern the rise in gun crime and domestic burglary, the growing demoralisation of the police, the increasing sense of helplessness of the honest citizen and the apparent inability of the Government to provide a coherent, long-term strategy to resolve these problems; and deprecates the Home Secretary's resort to short-term, irrelevant and illiberal measures to conceal this failure—(Mr Oliver Letwin);

An Amendment was proposed to the Question, in line 2, to leave out from the word ‘House' to the end of the Question and add the words ‘welcomes the steps the Government has taken and continues to take to reform all aspects of law enforcement including increasing police numbers to record levels and the 6.1 per cent. increase in police funding for 2003–04; further welcomes the steps the Government is taking to modernise the criminal justice system through the coherent long-term strategies and the introduction of the Criminal Justice Bill; notes that for the last five years crime rates have fallen by 27 per cent. according to the British Crime Survey, that burglary has reduced by 39 per cent. since 1997 and that the chances of becoming a victim of crime are as low as at any time in the last 20 years; and particularly supports the decisive action being taken by the Government to tackle street crime and the rise in gun-related crime', instead thereof.—(Mr Secretary Blunkett.)

Resolved, That this House welcomes the steps the Government has taken and continues to take to reform all aspects of law enforcement including increasing police numbers to record levels and the 6.1 per cent. increase in police funding for 2003–04; further welcomes the steps the Government is taking to modernise the criminal justice system through the coherent long-term strategies and the introduction of the Criminal Justice Bill; notes that for the last five years crime rates have fallen by 27 per cent. according to the British Crime Survey, that burglary has reduced by 39 per cent. since 1997 and that the chances of becoming a victim of crime are as low as at any time in the last 20 years; and particularly supports the decisive action being taken by the Government to tackle street crime and the rise in gun-related crime.

Drugs Policy,—A Motion was made, and the Question being proposed, That this House recognises the fundamental importance of the link between hard drugs and crime; and believes that the only means by which an effective onslaught on the hard drugs culture can be made is through mandatory intensive treatment and rehabilitation for young heroin and cocaine addicts—(Mr Oliver Letwin);

An Amendment was proposed to the Question, in line 2, to leave out from the word ‘House' to the end of the Question and add the words ‘recognises that focusing on Class A drugs, educating young people about the dangers of all drugs, preventing drug misuse, combating the dealers, reducing availability and treating addicts are all essential in tackling drugs; and welcomes the Government's updated Drug Strategy and the 44 per cent. increase in planned expenditure on combating drugs, from £1.026 billion in the current financial year to nearly £1.5 billion in the year starting April 2005', instead thereof.—(Mr Bob Ainsworth.)

And the Question being proposed, That the original words stand part of the Question;

2National Lottery,—A Motion was made, and the Question being put forthwith, pursuant to Standing Order No. 118 (Standing Committees on Delegated Legislation), That the draft National Endowment for Science, Technology and the Arts (Increase of Endowment) Order 2003, which was laid before this House on 11th December, be approved—(Mr Fraser Kemp):—It was agreed to.

2European Standing Committee A,—Mr Joe Benton reported from European Standing Committee A the following Resolution:

That the Committee takes note of European Union Document No. 13438/01, Commission Communication on a Community strategy for dioxins, furans and polychlorinated biphenyls; and supports the Government's objective that effective and proportionate measures are taken across the European Union in order to reduce emissions of, and exposure to, these substances, and to meet national, other regional and global commitments.

3Railways and Transport Safety Bill,—Mr Secretary Darling, supported by the Prime Minister, Mr Secretary Prescott, Mr Chancellor of the Exchequer, Mr Secretary Straw, Mr Secretary Blunkett, Mr Secretary Murphy, Secretary Peter Hain, Mr Secretary Smith, Mrs Secretary Liddell, Mr John Spellar and Mr David Jamieson, presented a Bill to make provision about railways, including tramways; to make provision about transport safety; and for connected purposes: And the same was read the first time; and ordered to be read a second time to-morrow and to be printed [Bill 40].

4Litter and Fouling of Land by Dogs,—Ordered, That leave be given to bring in a Bill to make further provision relating to litter and the fouling of land by dogs and to allow a local authority to retain the revenue from fixed penalty notices for such offences issued in its area for the purposes of enforcement: And that Mr Bob Blizzard, Andy Burnham, Michael Fabricant, Mr Doug Henderson, Mr David Lepper, Siobhain McDonagh, Mr Alan Meale, Lawrie Quinn, Jonathan Shaw and Mr Neil Turner do prepare and bring it in.

5Litter and Fouling of Land by Dogs Bill,—Mr Bob Blizzard accordingly presented a Bill to make further provision relating to litter and the fouling of land by dogs and to allow a local authority to retain the revenue from fixed penalty notices for such offences issued in its area for the purposes of enforcement: And the same was read the first time; and ordered to be read a second time on Friday 4th April and to be printed [Bill 41].

6Future of Education in Northern Ireland,—A Motion was made, and the Question being proposed, That this House urges the Secretary of State for Northern Ireland to honour the clearly expressed preference of a majority of the people of Northern Ireland to retain a selection procedure for transfer to post-primary schools, thus limiting the damage flowing from the administrative vandalism of the former Education Minister in the Northern Ireland Assembly; congratulates governors, principals, staff and pupils in Northern Ireland schools on achieving higher qualification levels at post-primary level than their counterparts in England and Wales; calls on the Government to maintain the levels of excellence achieved at so many schools while striving to enhance the performance and status of schools with a lesser level of achievement; regrets that too many able students from local grammar and secondary schools cannot obtain university places in Northern Ireland; calls for a change in household income thresholds to encourage higher uptake of discretionary awards; and urges the Government to honour its pledges to ensure a fair allocation of resources to education in Northern Ireland, including adequate research funding for Queen's University, Belfast and the University of Ulster—(Mr Roy Beggs);

An Amendment was proposed to the Question, in line 2, to leave out from the word ‘House' to the end of the Question and add the words ‘congratulates governors, principals, teachers and other school staff on the contribution they make to educating young people in Northern Ireland; welcomes the high qualifications achieved by many pupils but acknowledges that there are also large numbers of young people, particularly

Title accordingly amended, as follows: A Bill to make provision requiring social services authorities to make payments in cases where the discharge of patients is delayed for reasons relating to the provision of community care services or services for carers; and to enable the Secretary of State and the National Assembly for Wales to require certain community care services and services for carers provided by social services authorities to be free of charge to persons receiving those services.

An Amendment was proposed to the Question, in line 14, at the end, to add the words ‘notes the failure of European ministers to address adequately the issue of industrial fishing; believes that the measures agreed by the Fisheries Council will be ineffective in restoring white fish stocks; deplores the devastating and disproportionate impact that the policies embodied in these documents will have on the UK fishing industry; and calls on the Government to set out a clear strategy to conserve fish stocks, offer a sustainable future to the United Kingdom's fishing communities and to establish national and local control over the United Kingdom's fisheries.'.—(Mr John Hayes.)
