7Licensing Bill [Lords],—The House, according to Order, proceeded to consider the Licencing Bill [Lords], as amended in the Standing Committee.

Amendment (No. 162) proposed to the Bill, in page 109, line 31, at the end, to insert the words ‘for the entertainment or entertainment facilities'.—(Mr Malcolm Moss.)

Question proposed, That the Amendment be made:—Amendment, by leave, withdrawn.

Another Amendment (No. 64) proposed to the Bill, in page 111, line 27, to leave out from ‘2' to the end of line 28 and insert the words—

‘(2) For the purposes of sub-paragraph (1), the performance of live music or the playing of recorded music shall not be regarded as anything other than incidental to some other activity, merely because it has been advertised', instead thereof.—(Mr Malcolm Moss.)

‘Small events—live music

(1) The provision of entertainment consisting of the performance of live music is not to be regarded as the provision of regulated entertainment for the purposes of this Act where—

(a) the number of listeners or spectators present does not exceed 200 at any one time, and

(b) the entertainment ceases no later than 11.30 pm.

(2) The provision of entertainment facilities solely for the purposes of entertainment described in sub-paragraph (1) is not to be regarded as the provision of regulated entertainment for the purposes of this Act.

(3) Nothing in this paragraph shall be read as rendering invalid or otherwise affecting any provision of, or any regulation made under, any other legislation that applies to the entertainment, the entertainment facilities or the premises on which the entertainment is to take place.'.—(Mr Malcolm Moss.)

”(1A) Where the constitution, rules, standing orders, Memorandum, Articles of Association or other governing instrument of any club, society, company or other legal person (not being an individual) contains a provision (hereinafter called a “rule provision”) framed to comply with any enactment repealed by the Licensing Act 2003, the exemption afforded by subsection (1) shall continue to apply to that rule provision and anything done under it, notwithstanding the repeal of such enactments.”.'.—(Mr Malcolm Moss.)

11Broad Economic Policy Guidelines,—A Motion was made, and the Question being put forthwith, pursuant to Standing Order No. 119 (European Standing Committees), That this House takes note of European Union Document No. 8475/03, Commission Recommendation on the Broad Guidelines of the Economic Policies of the Member States and the Community (for the 2003–05 period); and supports the Government's welcome for the publication of the Recommendation and the operational context it provides for addressing the key economic policy issues and priorities over the next three years, in line with the European Union's strategic goal agreed at the Lisbon European Council—(Derek Twigg):—It was agreed to.

5Older People's Rights Commissioner,—Ordered, That leave be given to bring in a Bill to make provision for the establishment of an Older People's Rights Commissioner to promote and protect the human rights of older people; to make provision in respect of the recognition of such rights by public and private bodies; to assist older people in respect of such rights; to make provision for the powers and duties of the Commissioner; and for connected purposes: And that David Taylor, Ms Candy Atherton, Mr Roger Berry, Mr Harold Best, Mr David Chaytor, Mr David Drew, Paul Flynn, Linda Gilroy, Mr John Horam, Dr Brian Iddon, Mr Andy Reed and Mrs Betty Williams do prepare and bring it in.

6Older People's Rights Commissioner Bill,—David Taylor accordingly presented a Bill to make provision for the establishment of an Older People's Rights Commissioner to promote and protect the human rights of older people; to make provision in respect of the recognition of such rights by public and private bodies; to assist older people in respect of such rights; to make provision for the powers and duties of the Commissioner; and for connected purposes: And the same was read the first time; and ordered to be read a second time on Friday 11th July and to be printed [Bill 124].

7Opposition Day [9th allotted day],—It being an allotted day at the disposal of the Leader of the Opposition in pursuance of Standing Order No. 14 (Arrangement of public business), the House proceeded to consider Opposition business.

Constitutional Implications of the Prime Minister's Reshuffle,—A Motion was made, and the Question being proposed, That this House notes the far-reaching constitutional implications of the changes to the machinery of Government announced in the Government reshuffle last week; deplores the total lack of consultation before the changes were announced and the confusion that has ensued since; is gravely concerned that the Prime Minister is abolishing the historic office of Lord Chancellor without any

idea of what will take its place, and, in particular, how the independence of the judiciary is to be maintained; is unclear about the relationship between the spokesmen for Scotland and Wales in the House of Commons and the new Secretary of State for Constitutional Affairs, who appears to have executive responsibility for the functions of the Scotland and Wales Offices; regrets that the Prime Minister clearly regards the jobs of the Secretary of State for Transport and Leader of the House as part-time; further notes that the NHS in England and Wales is now to be run by a Secretary of State who has no control over health policies in his own constituency, and whose constituents will not be affected by the decisions he takes as Secretary of State for Health; and calls on the Prime Minister not to proceed with his plans for change until he has properly consulted on them—(Mr Eric Forth);

An Amendment was proposed to the Question, in line 2, to leave out from the word ‘House' to the end of the Question and add the words ‘welcomes the Government's continuing drive to modernise the constitution and public service by creating a new Department for Constitutional Affairs focused on improving the criminal justice system, by consulting on establishing an independent Judicial Appointments Commission, by consulting on establishing a Supreme Court, and by consulting the House of Lords on the appointment by the House of its own Speaker, and putting in place better arrangements for the conduct of Scottish and Welsh business after the successful bedding-down of devolution; further welcomes the continued accountability of the Secretaries of State for Scotland and Wales to the House; further welcomes the appointment of the new Secretary of State for Health who will continue the drive to reform and modernise the National Health Service; and supports the Government in its continued commitment to invest and reform the public services', instead thereof.— (Mr Peter Hain.)

Community Pharmacies,—A Motion was made, and the Question being proposed, That this House believes community pharmacies play a vital role in providing for local healthcare needs, with highly qualified pharmacists able to advise on general and over-the-counter medicines and to dispense and to advise on prescription-only medicines; notes that community pharmacies are truly local, with nine out of ten people considering it easy to get to a community pharmacy; and is concerned about any change which might lead to a reduction in the excellent services or accessibility currently provided by community pharmacies—(Mr Tim Yeo);

An Amendment was proposed to the Question, in line 2, to leave out from the word ‘House' to the end of the Question and add the words ‘agrees that the OFT report on the “Control of Entry Regulations and Retail Pharmacy Services in the UK” provides a useful analysis of the market impact of the current control of entry regulations on consumers and competition and highlights the need for the present regime governing pharmacies to be updated; favours change to open up the market and improve quality and access without diminishing the crucial role that community pharmacies play, especially in poorer areas; and supports the need for a balanced package of measures which plays to the strengths of community pharmacies and enhances the role of pharmacists in the modern NHS', instead thereof.—(Ms Secretary Hewitt.)
