The House met at half-past Two o'clock.

PRAYERS.

1Water Bill [Lords],—The Order of the day being read, for the Second Reading of the Water Bill [Lords];

And a Motion being made, and the Question being proposed, That the Bill be now read a second time;

An Amendment was proposed to the Question, to leave out from the word ‘That' to the end of the Question and add the words ‘this House declines to give a Second Reading to the Water Bill [Lords] because it fails to provide the strategic framework to meet the challenges posed by the European Water Framework Directive and to ensure the long-term provision of safe, clean water across England and Wales; does not make adequate provision for water resources in areas such as the south east of England where new housing is planned; undermines current customer structures; and fails to make proper provision for water conservation and flood prevention', instead thereof.—(Mr David Lidington.)

And the Question being put, That the Amendment be made;

2Water Bill [Lords] (Programme),—A Motion was made, and the Question being put forthwith, pursuant to Orders [28th June 2001 and 29th October 2002], That the following provisions shall apply to the Water Bill [Lords]:

Committal

1. The Bill shall be committed to a Standing Committee.

Proceedings in Standing Committee

2. Proceedings in the Standing Committee shall (so far as not previously concluded) be brought to a conclusion on Tuesday 21st October 2003.

3. The Standing Committee shall have leave to sit twice on the first day on which it meets.

Consideration and Third Reading

4. Proceedings on consideration shall (so far as not previously concluded) be brought to a conclusion one hour before the moment of interruption on the day on which those proceedings are commenced.

5. Proceedings on Third Reading shall (so far as not previously concluded) be brought to a conclusion at the moment of interruption on that day.

6. Sessional Order B (programming committees) made on 28th June 2001 shall not apply to proceedings on consideration and Third Reading.

Other proceedings

7. Any other proceedings on the Bill (including any proceedings on consideration of Lords amendments or any further message from the Lords) may be programmed—(Mr Nick Ainger);

3Water Bill [Lords] [Money],—Her Majesty's Recommendation having been signified to the proposed Motion relating to Water Bill [Lords] [Money];

A Motion was made, and the Question being put forthwith, pursuant to Standing Order No. 52 (Money and ways and means resolutions in connection with bills), That, for the purposes of any Act resulting from the Water Bill [Lords], it is expedient to authorise the payment out of money provided by Parliament of—

(a) any expenditure incurred by the Secretary of State under the Act,

(b) any increase attributable to the Act in the sums payable out of money so provided under any other enactment—(Mr Nick Ainger):—It was agreed to.

4Water Bill [Lords] [Ways and Means],—A Motion was made, and the Question being put forthwith, pursuant to Standing Order No. 52 (Money and ways and means resolutions in connection with bills), That, for the purposes of any Act resulting from the Water Bill [Lords], it is expedient to authorise—

(1) the extension of charging schemes of the Environment Agency under the Environment Act 1995;

(2) the extension of matters which may be covered by conditions included in an appointment under Chapter 1 of Part 2 of the Water Industry Act 1991 by virtue of section 11(1)(c) of that Act;

(3) the imposition of penalties on companies holding appointments under Chapter 1 of Part 2 of the Water Industry Act 1991, on companies holding licences under Chapter 1A of that Part of that Act (‘water supply licences'), and (by virtue of the application of section 111 of the Enterprise Act 2002) on other persons;

(4) the inclusion in water supply licences of conditions requiring the rendering of payments to the Secretary of State;

(5) the payment of sums into the Consolidated Fund—(Mr Nick Ainger):—It was agreed to.

5Planning and Compulsory Purchase Bill (Programme) (No. 2),—A Motion was made, and the Question being put forthwith, pursuant to Orders [28th June 2001 and 29th October 2002], That the following provisions shall apply to the Planning and Compulsory Purchase Bill for the purpose of supplementing the Order of 17th December 2002:

Proceedings in Standing Committee (re-committed Bill)

1. Proceedings in the Standing Committee on re-committal shall (so far as not previously concluded) be brought to a conclusion on Thursday 23rd October 2003.

2. The Standing Committee shall have leave to sit twice on the first day on which it meets—(Paul Clark);

6Three Communicable Diseases,—A Motion was made, and the Question being put forthwith, pursuant to Standing Order No. 119 (European Standing Committees), That this House takes note of European Union Document No. 7115/03, Commission Communication on the EC Programme of Action on HIV/AIDS, malaria and tuberculosis in the context of poverty reduction; welcomes the update and considers this an important area for reducing poverty; and encourages the Commission to do more work on these diseases, including increasing access to essential medicines and strengthening health systems—(Mr Thomas McAvoy):—It was agreed to.

7Northern Ireland Grand Committee,—Ordered, That—

(1) the matter of the future direction of community relations policy in Northern Ireland, being a matter relating exclusively to Northern Ireland, be referred to the Northern Ireland Grand Committee;

(2) the Committee shall meet at Westminster on Thursday 23rd October at half-past Two o'clock; and

(3) at that sitting—

(a) the Committee shall consider the matter referred to it under paragraph (1) above;

(b) the Chairman shall interrupt proceedings not later than two hours after their commencement; and

(c) at the conclusion of those proceedings, a motion for the adjournment of the Committee may be made by a Minister of the Crown, pursuant to paragraph (5) of Standing Order No. 116 (Northern Ireland Grand Committee (sittings)).—(Mr Thomas McAvoy.)

8Standards and Privileges,—Ordered, That Tom Levitt be discharged from the Committee on Standards and Privileges.—(Mr Thomas McAvoy.)

6Opposition Day [15th allotted day],—It being an allotted day at the disposal of the Leader of the Opposition in pursuance of Standing Order No. 14 (Arrangement of public business), the House proceeded to consider Opposition business.

Military Situation in Iraq,—Resolved, That this House takes note of the military situation in Iraq.—(Mr Bernard Jenkin.)

Teacher Shortages,—A Motion was made, and the Question being proposed, That this House notes that thousands of teaching posts have been lost in schools as a result of this year's funding crisis; condemns the Government for failing to respond early enough to reports of these redundancies, instead seeking to lay the blame on local authorities; further condemns the Government for not using any of the Department for Education and Skills' underspent money to alleviate this crisis; further notes that schools are having to ask parents for regular contributions to alleviate cash shortages; is concerned about the effect of these redundancies among teachers and support staff on the implementation of the Workload Agreement; and urges the Government to simplify the funding system for schools so that there will be no repeat of this year's problems in the recruitment and retention of teachers—(Mr Damian Green);

Fairness and Security in Old Age,—A Motion was made, and the Question being proposed, That this House believes that this Government has failed to deliver fairness and security for older people; is concerned that home care services for older people have been cut back and that the Government has presided over the collapse of the care home sector through botched regulations and underfunding; condemns the Government for putting in place rules that allowed thousands of elderly people to be forced to give up their life savings and homes to fund their continuing healthcare; believes that the Government has failed to tackle the pensions crisis both for current and future pensioners, putting in place a complex system of means-tests that fails to get help to the poorest pensioners, whilst heaping extra costs on pensioners by relying on the unfair Conservative council tax to fund local services; is concerned that many pensioners will suffer as a result of the closure of local post offices, a problem made worse by the Government's plans to scrap the pension book and introduce direct payment; and calls on the Government to stabilise the care home and home care sectors, offer security and real choice to older people, simplify the pension system, boost the basic state pension and abolish the council tax and replace it with a tax related to ability to pay—(Mr Paul Burstow);

Role of the United Nations in Iraq,—A Motion was made, and the Question being proposed, That this House welcomes the publication of the recent draft resolution of the United Nations Security Council on Iraq; calls upon Her Majesty's Government to honour the Prime Minister's commitment to give the United Nations a vital role in the political and economic reconstruction of Iraq through a new Security Council Resolution which would expedite the restoration of sovereignty and democratic control to the Iraqi people, place the process of political transition under the auspices of the United Nations, transfer the whole responsibility for the economic reconstruction and rebuilding of Iraq to an Iraqi provisional government assisted as necessary by the United Nations and replace existing security arrangements with a multinational force under unified command obliged to report to the Security Council—(Mr Menzies Campbell);

An Amendment was proposed to the Question, in line 2, to leave out from the word ‘House' to the end of the Question and add the words ‘supports the vital role played by the United Nations in Iraq as endorsed by UN Security Council Resolutions 1483 and 1500 (2003); pays tribute to the Secretary General's Special Representative, Sergio Vieira de Mello and his colleagues brutally murdered in the terrorist atrocity of 19th August; welcomes the determination of the United Nations Secretary General to remain engaged in Iraq; further welcomes the initiation of discussions on a new UN Security Council Resolution on Iraq, which aims to reaffirm the United Nations' support for the work of
