Inspections

    'After section 73E of the 1991 Act (as inserted by section 54above) there is inserted—

"Inspections

    73F Guidance about street authority inspections

    (1)   The Secretary of State may issue or approve guidance to street authorities about any matter relating to the exercise by them of any power to carry out inspections of street works (including inspections following their completion).

    (2)   In exercising their powers to carry out such inspections a street authority shall have regard to any guidance issued or approved under this section.

    (3)   In this section any reference to inspections includes the carrying out of investigatory works.".'.

Street and road works undertaken by local highway authorities

       'It shall be a duty on every local highway authority to have regard to the need to keep traffic flowing when undertaking street and road works. They will be treated the same as other bodies and companies carrying out works that include street and road works.'.


Works to motorways and trunk roads

       'The Highways Agency shall carry out any works to motorways and trunk roads entailing the closure or narrowing of lanes after 8 pm and before 6 am or at weekends.'.


Bus lanes

      (a) shall be open to use by cycles, motorcycles, licensed taxis and invalid vehicles; and

Red traffic lights

Traffic signals with all red phases

Maximum speed limits on dual or treble carriageways

Planning applications

      (a) the impact of the proposed development on traffic-flows and congestion;

      (d) the need for delivery access to commercial developments.'


Repeal of section 74A of New Road and Street Works Act 1991

Traffic lights

       'In exercising their network management duty, a local traffic authority shall be required to monitor all traffic lights in operation in their area and shall—

      (a) ensure that all traffic lights operate on a traffic sensitive basis during non-rush hour periods;

      (b) require that traffic lights are set to achieve the most expeditious flow of traffic and pedestrians at all times they are operational;

      (c) require that unless there are good reasons for not so doing that traffic lights at junctions with low traffic volumes operate in amber warning mode in all directions during non-rush hour periods.'.


Use of bus lanes

       'Any motor vehicle with two or more passengers shall be entitled at any time to use any carriageway marked out as a bus lane.'.


Provision of parking spaces for car clubs

    '(1)   It is the duty of a local traffic authority to make such arrangements as they consider appropriate to facilitate the operation of car clubs in order to secure the reduction of road congestion.

    (2)   A local traffic authority shall require every organisation seeking to operate as a car club to register their constitution, rules and membership numbers and may at their discretion approve such an organisation as a registered car club.

    (3)   The arrangements in subsection (1) shall include the provision of parking spaces for which they do not make a charge for the sole use of registered car clubs.'.


Network management duty

    '(1)   It shall be the duty of the Secretary of State or the Assembly to achieve, as far as may be reasonably practicable, the following objectives:

      (a) securing the safe and expeditious movement of traffic on the relevant road network; and

      (b) facilitating the safe and expeditious movement of traffic on road networks for which another authority is the traffic authority.

    (2)   In this clause, "relevant road" means a road in England for which the Secretary of State is the traffic authority or a road in Wales for which the Assembly is the traffic authority.'.


Annual report to parliament

       'A report on the scale, activities and effectiveness of the work of traffic officers shall be presented on an annual basis to Parliament by the Secretary of State.'.


Duty to consult

       'In monitoring and evaluating the work and effectiveness of traffic officers, the appropriate national authority shall establish and consult with an advisory group comprising such members as may be considered appropriate.'.


Consultation

       'Prior to the issuing of intervention notices or orders, the Secretary of State shall consult with such organisations as he considers appropriate over the content and timing of such orders and notices and over the criteria against which the performance of a local authority may be assessed.'.


Report to parliament

       'The Secretary of State shall present a report on an annual basis to Parliament on the number and nature of intervention notices and orders issued in the previous year and their effects on local traffic authority performance with specific references to improvements in road safety.'.


Traffic Management Forum

*To move the following Clause:—

    '(1)   The appropriate national authority shall create a Traffic Management Forum.

    (2)   Membership of the Traffic Management Forum shall comprise representatives from the Department for Transport, the Highways Agency, the Local Government Association, the Association of Chief Police Officers, accredited recovery organisations and such other bodies or persons as the appropriate national authority considers suitable.

    (3)   The Traffic Management Forum shall prepare a Code of Practice (the Code) to be observed by traffic officers, by accredited recovery organisations and by any organisations providing services equivalent to those provided by accredited recovery organisations (collectively known as rescue and recovery organisations).

    (4)   The Code shall include guidance on—

      (a) the exercise by traffic officers of powers under sections 99 to 102 of the Road Traffic Regulation Act 1984 to remove broken down vehicles;

      (b) procedures to be adopted by traffic officers and by rescue and recovery organisations in order to achieve the purposes identified in section 5(3); and

      (c) any further and consequential matters that relate to the existance provided by rescue and recovery organisations in the performance by traffic officers of their duties under this Act.

    (5)   The Traffic Management Forum may from time to time prepare a revised version of the Code.

    (6)   Before preparing or revising the Code, the Traffic Management Forum shall consult such bodies or persons as it considers appropriate.

    (7)   After preparing the Code or a revised version of the Code the Traffic Management Forum shall send a copy to the appropriate national authority.

    (8)   If the appropriate national authority approves it, the Code shall be laid before each House of Parliament and the Code, and any revised version of the Code, shall not come into force until has has been approved by a resolution of each House of Parliament.

    (9)   The appropriate national authority shall not issue any guidance on the issues detailed in subsection (4) without first consulting the Traffic Management Forum.

    (10)   For the purposes of this section "accredited recovery organisations" shall have the meaning contained in The Greater London (Central Zone) Congestion Charging Order 2001.'.
