Referendums (Thresholds) Bill

Bill

To

Amend the Political Parties, Elections and Referendums Act 2000 to make

provision to set thresholds in respect of referendums; and for connected

purposes. 

Be it enacted by the Queen’s most Excellent Majesty, by and with the advice and

consent of the Lords Spiritual and Temporal, and Commons, in this present

Parliament assembled, and by the authority of the same, as follows:—

Amendment of the Political Parties, Elections and Referendums Act 2000

(1)   

The Political Parties, Elections and Referendums Act 2000 (c. 41) is amended as

follows.

(2)   

After section 104 there is inserted—

“104A   

Thresholds

If it appears to the Chief Counting Officer for the referendum that fewer

than 50 per cent. of the persons entitled to vote in any referendum to

which section 101 applies have voted, the question proposed in the

referendum shall be deemed to have been answered in the negative.”

Amendment of the Regional Assemblies (Preparations) Act 2003

(1)   

The Regional Assemblies (Preparations) Act 2003 (c. 10) is amended as follows.

(2)   

After section 6(1)(b) there is inserted—

“(c)   

if it appears to the Chief Counting Officer that fewer than 50 per

cent of the persons entitled to vote in the referendum have

voted.”

Short title and extent

(1)   

This Act may be cited as the Referendums (Thresholds) Act 2004.

(2)   

Section 1 extends to the whole of the United Kingdom.
