"(2A) Any regulations under this section prescribing grants for living costs must secure that, for eligible students in respect of whom the relevant income is below £15,000 in current prices, payments from—

(a) bursaries paid by the institution providing the relevant course,

(b) grants payable under regulations under this section, or

(c) both combined

 amount to no less than £1,000 per year from the beginning of academic year 2004-05 and £3,000 per year from the beginning of academic year 2006-07.

(2B) The amount specified in subsection (2A) shall be increased each year by regulations by an amount equal to the increase in the retail price index in the relevant preceding period.

(2C) The relevant income means the income of—

(a) the student,

(b) the parent or parents of the student, or

(c) the student's spouse.".'.

NEW CLAUSES

Commission to conduct independent review of operation of provisions of Part 3

To move the following Clause:—

    '(1)   Within three years of the date specified in subsection (2) a commission shall be appointed in accordance with the provisions of subsection (3) to conduct an independent review of the operation of Part 3 of this Act ("the new arrangements").

    (2)   The date specified in this subsection is the first day on which qualifying fees are set which exceed the basic amount.

    (3)   The commission shall consist of—

(a) a chairman appointed by the Secretary of State,

(b) such number of other members appointed by the Secretary of State as the Secretary of State thinks fit, and

(c) a member appointed by the National Assembly for Wales.

    (4)   The review shall, in particular, consider—

(a) the impact of the new arrangements on higher education institutions, including—

(i) charging policies, and how far institutions have varied their fees,

(ii) the additional income institutions have raised and how they have used it,

(iii) the provision of bursaries and other financial support,

(iv) any effect on the range, mix and take-up of subjects and qualifications offered, including any effect on foundation degrees, courses lasting longer than three years and the regional composition of provision by institutions, and

(v) a financial assessment of the relative impact on different parts of the higher education sector, and any analysis of future funding pressures;

(b) the impact of the new arrangements on students and prospective students, including—

(i) the overall level of applications and participation in higher education,

(ii) student support arrangements, including those for those from the poorest backgrounds as well as those above the threshold for Government support,

(iii) choice of institution and course and mode of study,

(iv) quality of teaching received, attainment and likelihood of completing a course,

(v) levels of debt, students' assessment of the value of higher education and rates of return from gaining a degree,

(vi) patterns in subsequent employment, including particularly recruitment to the public services, or decisions to go on to further study, and

(vii) any differential effect on particular groups, including lower socio-economic groups, men and women, different ethnic groups, people with disabilities and people from different regions; and

(c) the implications for future policy, including—

(i) whether any improvements should be made to the graduate contribution scheme and the upper limit for tuition fees, and

(ii) what changes should be made to the arrangements for student support in order to ensure that students from the poorest family backgrounds on the most expensive courses receive support at a level equivalent to the maximum level of fees.

    (5)   The commission shall within nine months of its appointment lay before each House of Parliament a report on the findings of its review.'.
