Bill

To

Make provision about the registration of telecommunications masts.                                      

Be it enacted by the Queen’s most Excellent Majesty, by and with the advice and

consent of the Lords Spiritual and Temporal, and Commons, in this present

Parliament assembled, and by the authority of the same, as follows:—

1       

Amendment of the Telecommunications Code

(1)   

Schedule 2 of the Telecommunications Act 1984 is amended as follows.

(2)   

After paragraph 29, insert—

Registration of telecommunications masts

30    (1)  

The Secretary of State shall by regulations prescribe—

(a)   

the operators (“paragraph 30 operators”) and

(b)   

the telecommunications masts and associated apparatus

           

to which this paragraph and paragraph 31 shall apply.

      (2)  

Paragraph 30 operators must inform—

(a)   

Ofcom, and

(b)   

the planning authority in which any telecommunications

masts and associated apparatus is located,

           

of the location of such telecommunications masts and associated

apparatus.

      (3)  

The information required under subparagraph (2) must be

provided—

(a)   

in the case of existing telecommunications masts and

associated apparatus, within one month of

Telecommunications Masts (Registration) Act 2004 coming

into force, and

(b)   

in the case of telecommunications masts and associated

apparatus erected after this date, within one month of their

erection.

      (4)  

Ofcom shall publish the information that it receives under this

paragraph on its website within one month of receiving it.

      (5)  

Each planning authority shall publish each year on its website a

report relating to the telecommunications masts and associated

apparatus which are located in its area.

      (6)  

The power to make regulations under this section is exercisable by

statutory instrument which shall be subject to annulment in

pursuance of a resolution of either House of Parliament.

Meetings with planning authorities

31         

Each planning authority shall have a meeting each year with the

paragraph 30 operators who have erected or intend to erect

telecommunications masts and associated equipment in the

planning authority’s area.”.

Citation

(1)   

This Act may be cited as the Telecommunications Masts (Registration) Act
