Telecommunications (Permitted Development Rights) (Amendment) Bill






amend the Town and Country Planning (General Permitted Development)

Order 1995 to require that the erection of a telecommunications mast can only

take place under permitted development rights when it has been shown that

the operator has complied with the Code of Practice of the operators of mobile

telecommunications systems. 

Be it enacted by the Queen’s most Excellent Majesty, by and with the advice and

consent of the Lords Spiritual and Temporal, and Commons, in this present

Parliament assembled, and by the authority of the same, as follows:—


Amendment of the Town and Country Planning (General Permitted

Development) Order 1995

The Town and Country Planning (General Permitted Development) Order

1995 (SI 1995/418) is amended, in Schedule 2, Part 24 (Development by

telecommunications code system operators), after paragraph A.2(2), by



“ (2A)   Class A(a) and Class A(c) development is permitted subject to the

condition that the operator shall comply with the Code of Best Practice on

Mobile Phone Network Development issued by the Office of the Deputy Prime

Minister in November 2002 (or any code issued with the authority of the


Secretary of State in place of that code).”


Short title, commencement and extent

This Act—


may be cited as the Telecommunications (Permitted Development

Rights) (Amendment) Act 2004;



comes into force at the end of the period of two months beginning with

the day on which it is passed; and


extends to England and Wales only.
