Domestic Energy Efficiency Bill

A

Bill

To

Make provision for energy efficiency in relation to fuel poverty and social

housing. 

Be it enacted by the Queen’s most Excellent Majesty, by and with the advice and

consent of the Lords Spiritual and Temporal, and Commons, in this present

Parliament assembled, and by the authority of the same, as follows:—

Identification of persons suffering from fuel poverty

(1)   

The Secretary of State shall by regulations make provision for the identification

of persons suffering from fuel poverty.

(2)   

Regulations under subsection (1) may make provision for—

(a)   

the co-operation of medical practitioners, social care workers and

public electricity and gas suppliers in the identification of persons

suffering from fuel poverty, and

(b)   

the establishment and maintenance of a database of such persons.

Inspection of boilers and other appliances used for space and water heating

(1)   

The Secretary of State shall by regulations make provision for the inspection of

boilers and other appliances used for space and water heating in the homes of

persons suffering from fuel poverty.

(2)   

Regulations under subsection (1) may make provision for —

(a)   

issuing guidance about the inspection of boilers and other appliances

used for space and water heating in the homes of persons suffering

from fuel poverty, and

(b)   

the definition of “boilers and other appliances used for space and water

heating”.

3       

Energy performance of social housing

(1)   

The Secretary of State shall make provision for—

(a)   

assessing the energy performance of housing owned by registered

social landlords or local authorities, and

(b)   

issuing certificates which record the energy performance of such

housing (“energy certificates”).

(2)   

Regulations under subsection (1) may make provision for—

(a)   

guidance to persons assessing the energy performance of housing

owned by registered social landlords or local authorities,

(b)   

guidance about the form and content of energy certificates, and

(c)   

the definition of “energy performance”.

4       

Money

There shall be paid out of money provided by Parliament

(a)   

any expenditure incurred by the Secretary of State by virtue of this Act, and

(b)   

any increase attributable to this Act in the sums payable out of money so

provided by virtue of any other enactment.

Interpretation

In this Act—

“fuel poverty” has the same meaning as in the Warm Homes and Energy

Conservation Act 2000 (c. 31);

“gas supplier” has the same meaning as in the Gas Act 1986 (c. 44);

“medical practitioner” has the same meaning as in the National Health

Service Act 1977 (c. 49);

“public electricity supplier” has the same meaning as in the Electricity Act

1989 (c. 29);

“registered social landlord” has the same meaning as in the Housing Act

1996 (c. 52); and

“social care worker” has the same meaning as in the Care Standards Act

2000 (c. 14).

Short title and extent

(1)   

The Act may be cited as the Domestic Energy Efficiency Act 2004.

(2)   

This Act extends to England only.
