MENTAL CAPACITY BILL

RESOLUTION OF THE PROGRAMMING SUB-COMMITTEE

The Programming Sub-Committee appointed by the Speaker in respect of the Bill agreed the following Resolution at its meeting on Monday 18th October (Sessional Order C relating to Programming):

That—

    (1)   during proceedings on the Mental Capacity Bill, the Standing Committee shall (in addition to its first meeting on Tuesday 19th October at 9.30 a.m.) meet on—

(a) Tuesday 19th October at 2.30 p.m.,

(b) Thursday 21st October at 8.55 a.m. and 2.30 p.m.,

(c) Tuesday 26th October at 8.55 a.m. and 2.30 p.m.,

(d) Thursday 28th October at 8.55 a.m. and 2.30 p.m.,

(e) Tuesday 2nd November at 8.55 a.m. and 2.30 p.m.,

(f) Thursday 4th November at 8.55 a.m. and 2.30 p.m.;

    (2)   proceedings in the Standing Committee shall be taken in the following order, namely Clauses 1 to 9, Schedule 1, Clauses 10 to 18, Schedule 2, Clauses 19 to 59, Schedule 3, Clauses 60 to 62, Schedules 4 and 5, Clause 63, Schedules 6 and 7, Clauses 64 and 65, new Clauses, new Schedules, remaining proceedings on the Bill;

    (3)   the proceedings on Clauses 1 to 9, Schedule 1, Clauses 10 to 18, Schedule 2 and Clauses 19 to 27 shall (so far as not previously concluded) be brought to a conclusion at 5 p.m. on Tuesday 26th October;

    (4)   the remaining proceedings shall (so far as not previously concluded) be brought to a conclusion at 5 p.m. on Thursday 4th November.

Mr David Lammy has given notice of his intention to move a motion in the terms of the Resolution of the Programming Sub-Committee [Sessional Order C (9) relating to Programming].

    '(9)   Where it appears to a relevant authority that—

(a) a person, "C", is engaged in caring for another person, "P", and

(b) section 5 may apply to acts in connection with the care or treatment provided by C to P, and

(c) C is not a person to whom section 40(4) applies (those individuals who are under a duty to comply with the Code)

       that authority shall provide C with the codes of practice referred to in section 40(1)(b) (guidance for persons acting in connection with the care or treatment of another person) and take any other steps as it considers reasonably necessary to assist C in complying with section 5(1) (ensuring that P lacks capacity and reasonably believing that the act is in P's best interests).

    (10)   For the purpose of subsection (9) "relevant authority" means either—

(a) a local authority exercising functions under section 47 of the National Health Service and Community Care Act 1990, or

(b) a Health Authority, Local Health Board, Special Health Authority, Primary Care Trust or National Health Service trust which is responsible for providing or arranging services under the National Health Act 1997.'.
